The unit canteen must apply for a food business license, otherwise it will be operating without a license and is illegal.
A business license is a certificate issued by the industrial and commercial administration authority to industrial and commercial enterprises and individual traders allowing them to engage in certain production and business activities. Its format is uniformly stipulated by the State Administration for Market Regulation.
The registration matters are: name, address, person in charge, amount of funds, economic composition, business scope, business method, number of employees, business period, etc. The business license is divided into original and duplicate, both of which have the same legal effect. The original copy shall be placed in a conspicuous place at the company's residence or business premises, and the business license shall not be forged, altered, rented, lent or transferred.
Industrial and commercial enterprises or self-employed individuals without a business license are not allowed to open their business. They are not allowed to engrave official seals, sign contracts, register trademarks, or publish advertisements. They are not allowed to open bank accounts.
The original and duplicate copies of the business license have the same legal effect and there is no difference in substance. If we talk about the difference, it is just the appearance. In terms of use, the original must be hung in a conspicuous place in the business premises, otherwise you may be punished for not hanging the license. Copies are generally used to handle business when going out, such as bank account opening licenses, corporate organization code certificates, tax Registration certificate, signed contract, etc.
Industrial and commercial registration requires preparation of the following aspects:
1. Company establishment registration application signed by the company’s legal representative;
2. All shareholders Signed articles of association;
3. Qualification certificate of legal person shareholder or ID card of natural person shareholder and its copy;
4. Appointment documents and ID card copies of directors, supervisors and managers ;
5. Proof of designated representative or entrusted agent;
6. Agent’s ID card and its copy;
7. Proof of use of residence.

Article 35 The state implements a licensing system for food production and operation. Those engaged in food production, food sales, and catering services must obtain licenses in accordance with the law. However, the sale of edible agricultural products and the sale of prepackaged food only do not require a license. Those who only sell pre-packaged food must report to the food safety supervision and administration department of the local people's government at or above the county level for registration.
The food safety supervision and administration department of the local people's government at or above the county level shall, in accordance with the provisions of the "Administrative Licensing Law of the People's Republic of China", review the application submitted by the applicant in accordance with Article 33, Paragraph 1 of this Law. If necessary, the relevant information required by items 1 to 4 will be inspected on-site at the applicant's production and business premises; if the applicant meets the specified conditions, the license will be granted; if the specified conditions are not met, the license will be denied and the reasons will be stated in writing.
