Trademark registration will not go through the local industrial and commercial department, but will be handled directly by the National Trademark Office and its affiliated registration agencies
It is recommended to contact a regular trademark agency for trademark registration, which can save money. Effortless and efficient, professional matters are left to professionals.
Currently, both individuals and companies can register and apply for trademarks. Individuals only need to provide self-employed business licenses and copies of ID cards for signature, and companies only need to provide business licenses and ID cards for signature. A copy of the license is stamped. The current trademark registration fee includes an official fee of 300 yuan and an agency service fee. The fees for each trademark agency are different
The official charging standard of the Trademark Office is 300 yuan/class/standard. That is to say, if you only register a category, the Trademark Office will charge 300 yuan. That is, if you choose a trademark name or pattern and submit it to the Beijing Trademark Office yourself, the fee will be 300 yuan. If you entrust a trademark agency to handle it, the process is relatively simple, and the agency will sort it all out, which is a way to save worry and effort. It is very important to conduct a trademark search before trademark registration. This is an important key to trademark registration.
Trademark registration process:
Step 1: Decide what kind of words, logo, or combination of words + logo will be used to represent your products or services.
Step 2: Conduct a preliminary trademark search, including searching on Google to see if the name has been used in the name of a company or product or service. Logo is usually less likely to clash with others. If you're not sure whether you crashed into someone, ask an expert. If you do have a serious crash, go back to the previous step.
Step 3: Find an agent, or go to the Trademark Office to submit a trademark application yourself. If it is the latter case, at least find a friend who understands trademarks to check whether the trademark classification to be registered is correct. It will take about six weeks after submission to receive the application from the Trademark Office, and it will take about one year for the trademark to be registered. Whether the registration is completed or not does not affect the use of the trademark. Even if the registration fails, the use of the trademark will not be affected. However, it is more difficult to sue others for trademark infringement, although you can still sue others for "unfair competition."
Documents required: proof of identity, company license (if the applicant/right holder is a company), power of attorney (if there is an agent), registration application.
The trademark is valid for 10 years and can be renewed thereafter. It should be noted that if a trademark is not used for three consecutive years, it may be invalidated at the request of others or by the Trademark Office.
Trademark inquiry (within 2 days) → application document preparation (within 3 days) → submission of application (within 2 days) → trademark formal review (1 month) → issuance of trademark acceptance notice → trademark substantive review (12 Months)→Trademark announcement (3 months)→Issuance of trademark certificate. (The new Trademark Law was implemented on May 1, 2014, and the substantive trademark review period is 9 months.)
