Trademark registration can have the same name. However, if the duplicate name causes the applied trademark to conflict with other people's prior rights, or is identical or similar to a trademark that others have applied for registration first, the Trademark Office will reject the registration application during the preliminary review process. That means you cannot apply for trademark registration.
