Improper use of others' rights refers to trademark infringement other than counterfeiting, copyright infringement other than piracy, patent infringement and other acts that infringe upon others' legitimate rights and interests. According to the seriousness of the case, points will be deducted, and 8 points will be deducted each time if the circumstances are minor; If the circumstances are serious, 25 points will be deducted each time according to serious violations; If the circumstances are particularly serious and have a significant impact, 1 points will be deducted each time according to serious violations.
Including but not limited to the following situations:
The seller improperly uses the rights of others in the published product information, pictures, store names and domain names used;
the seller is suspected of improper use of other people's trademark rights, copyrights, patents and other legal rights when selling goods;
The commodity information released by the seller or other information used by the seller causes confusion, misunderstanding or unfair competition among consumers. A complaint made by the same obligee to the same seller within 3 days is regarded as a complaint.
in case of infringement in violation of the provisions of this article, JD.COM has the right to take off the shelves and delete the goods or information released by the seller that improperly use other people's rights. At the same time, JD.COM has the right to take market supervision measures such as store blocking, store closing and restricting the release of goods according to the seriousness of the case.
