Private hygiene products belong to the 0501 group of Class 5 of the trademark classification.
To register a trademark, both the trademark registrant and the trademark must meet the conditions stipulated by law. There are two main aspects:
1. To apply for registered trademark in my country, the applicant needs to be from my country. Natural person, legal person or other organization. If a foreigner or foreign enterprise applies for trademark registration in our country, the Trademark Office will handle it in accordance with the agreement signed between his country of origin and our country or the international treaty that the country has signed, or in accordance with the principle of reciprocity;
2 , The trademark applied for registration must meet the following conditions:
(1) The trademark applied for registration must have constituent elements;
(2) It must be distinctive. It means that it is easy to identify and is different from other people’s trademarks;
(3) You cannot use signs that are prohibited by law. For example: country name, national flag, national emblem, etc.;
(4) If it belongs to the same or similar goods or services, the trademark cannot be the same or similar to another person’s registered or preliminary approved trademark;
(5) A trademark shall not be identical or similar to a registered trademark that has been canceled or has been canceled for less than one year.
Article 3 of the Trademark Law of the People's Republic of China A trademark approved and registered by the Trademark Office is a registered trademark, including commodity trademarks, service trademarks, collective trademarks, and certification marks; the trademark registrant enjoys the rights to the trademark Exclusive rights are protected by law.
The term "collective trademark" as mentioned in this Law refers to a mark registered in the name of a group, association or other organization for use by members of the organization in commercial activities to indicate the user's membership in the organization.
The term "certification trademark" as used in this Law means that it is controlled by an organization with the ability to supervise certain goods or services and is used by units or individuals other than the organization to certify the goods or services. The origin, raw materials, manufacturing methods, quality or other signs of specific quality of the goods or services.
Special matters concerning the registration and management of collective trademarks and certification marks shall be stipulated by the industrial and commercial administration department of the State Council.
Article 4 If a natural person, legal person or other organization needs to obtain the exclusive right to use a trademark for its goods or services during production and business operations, it shall apply to the Trademark Office for trademark registration. Bad-faith trademark registration applications that are not intended for use shall be rejected.
The provisions of this Law regarding commodity trademarks shall apply to service trademarks.
