Implementation Measures for Agricultural Machinery Promotion and Appraisal

Chapter 1 General Provisions

Article 1 In order to standardize the promotion and appraisal work of agricultural machinery, clarify the content, procedures and requirements of promotion appraisal, improve the promotion appraisal system, and improve the quality of promotion appraisal work, these measures are formulated in accordance with the "Agricultural Machinery Test and Appraisal Methods" .

Article 2 The agricultural machinery promotion appraisal (hereinafter referred to as the promotion appraisal) as mentioned in these Measures refers to the agricultural machinery testing and appraisal agency (hereinafter referred to as the agricultural machinery appraisal agency) through scientific testing, testing and assessment. Conduct a comprehensive assessment of the applicability, safety and reliability, make a technical evaluation, and assess whether it is suitable for promotion activities. Promotion appraisal includes ministerial-level promotion appraisal and provincial-level promotion appraisal.

Article 3 The promotion and identification work shall adhere to the principles of science, fairness, efficiency and unity, and promote the improvement of agricultural machinery product quality and the promotion and application of advanced and applicable, technologically mature, safe and reliable, energy-saving and environmentally friendly agricultural machinery.

Article 4 The Ministry of Agriculture is in charge of nationwide promotion and appraisal work, formulates, regularly adjusts and publishes national agricultural machinery promotion and appraisal product category guides, and publishes appraisal outlines. The General Station of Agricultural Machinery Testing and Appraisal of the Ministry of Agriculture organizes and implements ministerial-level promotion and appraisal, and provides guidance on provincial-level promotion and appraisal work.

The promotion of appraisal work at the ministerial level implements unified acceptance of applications, unified appraisal outlines, unified charging standards, overall planning and arrangement of tasks, and unified issuance of certificate marks.

The agricultural mechanization administrative departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government are responsible for the promotion and appraisal work in their respective administrative regions, formulating, regularly adjusting, and publishing provincial-level agricultural machinery promotion and appraisal product category guidelines, and publishing appraisal outlines. The specific work will be carried out by the agricultural machinery appraisal agency affiliated to the agricultural mechanization administrative department of the provincial people's government.

Article 5 The scope of products for promotion and appraisal shall be determined by the product category guide for promotion and appraisal published by the Ministry of Agriculture and the administrative departments of agricultural mechanization of provincial people’s governments.

Chapter 2 Application

Article 6 Applicants for promotion appraisal should be agricultural machinery producers with corporate legal person qualifications and have the conditions for stable production of qualified products and corresponding after-sales services Capacity, production and business activities are normal.

Overseas agricultural machinery manufacturers can entrust domestic sellers with corporate legal person status to sell their agricultural machinery products to apply on their behalf.

Article 7 Products applying for ministerial-level promotion appraisal should be finalized products, mass-produced for more than one year, and sold in more than two provinces (autonomous regions, municipalities directly under the Central Government). The cumulative sales volume meets the following requirements: no less than 500 units of small agricultural machinery products, no less than 100 units of medium-sized agricultural machinery products, and no less than 30 units (sets) of large agricultural machinery products (or complete sets of equipment). Requirements may be appropriately relaxed for national key promotions, urgently needed agricultural production or innovative products.

The sales area and cumulative sales volume of products applying for provincial promotion appraisal shall be determined by the agricultural mechanization administrative departments of the people's governments of each province, autonomous region, and municipality directly under the Central Government.

Article 8 Applicants for promotion of appraisal shall be responsible for the authenticity of the application materials. The application materials shall be stamped with the official seal of the legal person. The specific contents include:

(1) Application form for promotion of appraisal ( The reference format is shown in Appendix 1) in triplicate;

(2) A copy of the corporate business license. If applying as an agent, a copy of the registration certificate and power of attorney of the overseas client must also be provided;

(3) A copy of the product finalization certification document;

(4) A copy of the product implementation standard text and its registration certificate or filing materials;

(5) A copy of the product instruction manual;

(6) For products that are subject to production licensing and compulsory certification management by the state, a copy of the corresponding certificate and attachments shall be provided;

(7) Promotion of other documents and supporting materials specified in the appraisal outline.

The promotion appraisal application form should be filled out according to an independent application product. If it meets the requirements of the models covered by the promotion appraisal outline, it can be applied together with the host model. The production and sales of the covered models shall meet the requirements of Article 7 of these Measures respectively, and the materials required by Items (5) and (6) of this Article shall be provided respectively.

If the validity period of the promotion appraisal certificate expires and it is necessary to continue to maintain the qualification, the applicant for the original certificate should resubmit a promotion appraisal application in accordance with the provisions of this article one working season in advance or 6 months before the expiration of the validity period, but there is no need to provide this article Materials required by Item (3) of Paragraph 1.

The product type certification document can be the relevant appraisal certificate at or above the provincial level for the product being applied for, or the agricultural machinery type appraisal certificate at or above the provincial level, product quality certification certificate, production license and its attachments. The provincial promotion appraisal certificate can be used as the final certification document for applying for ministerial promotion appraisal products.

Chapter 3 Review and Acceptance

Article 9 The Ministry of Agriculture’s Agricultural Machinery Testing and Appraisal Station shall handle ministerial-level promotion appraisals, while provincial-level promotion appraisals shall be handled by the people’s governments of provinces, autonomous regions, and municipalities directly under the Central Government. The acceptance agencies announced by the administrative department of agricultural mechanization shall accept the applications uniformly.

Article 10 The acceptance agency is responsible for reviewing the enterprise’s application materials, deciding whether to accept the application within 10 days from the date of receipt of the application materials and notifying the applicant in writing. If the application is not accepted, the reasons shall be stated.

Article 11: Products that fall under any of the following circumstances will not be accepted:

(1) Products that are not included in the latest published guidelines for promotion and identification of product categories;

(2) Sales volume and sales area do not meet the requirements;

(3) Products that have been eliminated by the state;

(4) The application materials are incomplete or the content does not meet the requirements ;

(5) Other circumstances that should not be accepted.

Article 12 The accepting agency shall coordinate and arrange the promotion of appraisal tasks in accordance with the principles of justice, fairness, reasonableness and efficiency, and specify the time for completing the appraisal tasks. Each agricultural machinery appraisal agency shall report the appraisal work status to the agricultural mechanization administrative department of the people's government to which it belongs before the end of December each year.

Article 13 Applicants shall pay relevant fees to the institution that accepts and undertakes appraisal tasks in accordance with relevant regulations.

Chapter 4 Appraisal and Announcement

Article 14 The agricultural machinery appraisal agency responsible for ministerial-level promotion appraisal tasks shall pass the ministerial-level appraisal capability accreditation organized by the Ministry of Agriculture, and shall be within the scope of the accreditation. Carry out appraisal work within.

Agricultural machinery appraisal institutions that undertake the task of promoting appraisal at the provincial level shall pass the provincial appraisal capability accreditation organized by the agricultural mechanization administrative department of the provincial people's government to which they belong, and carry out appraisal work within the scope of the accreditation.

Article 15 Promotion appraisal shall be carried out in accordance with the general principles of promotion appraisal and the relevant product promotion appraisal outline issued by the Ministry of Agriculture and the administrative departments of agricultural mechanization of provincial people's governments. If there are general rules and outlines for the promotion of appraisal at the ministerial level, the appraisal shall be carried out in accordance with the general rules and outlines for the promotion of appraisal at the ministerial level.

The appraisal content includes:

(1) Technical requirements and performance test;

(2) Safety inspection;

(3) Reliability test;

(4) Applicability evaluation;

(5) Instructions for use review;

(6) Three-guarantee voucher review;

(7) Review of production conditions;

(8) User survey.

If an application is made in the name of a group company (head office), and its different subsidiaries and branches (factories) produce products with the same trademark (brand) and model, product testing and production condition review must be conducted separately.

Article 16 Personnel responsible for the review of production conditions shall have the qualification of promotion appraisal examiner. Personnel responsible for product testing and other work should have promotion appraisal inspector qualifications.

Article 17 The inspector or examiner shall confirm the authenticity of the application materials and the specified product technical specifications during the implementation of promotion appraisal.

Article 18 If an agricultural machinery appraisal agency independently completes the promotion appraisal task, the agency shall issue a promotion appraisal report. If the project is completed through cooperation, the leading agency will issue a promotion appraisal report. Agricultural machinery appraisal agencies are responsible for the promotion appraisal reports issued by them.

Agricultural machinery appraisal agencies that cooperate in completing promotion appraisal tasks shall reasonably allocate appraisal fees according to their respective workloads, and shall not exceed standard charges or duplicate charges.

Article 19 If the promotion appraisal project does not meet the appraisal requirements, the enterprise is allowed to rectify the content that can be rectified in the short term, but the rectification period shall not exceed 3 months. If it still does not meet the requirements after rectification, the promotion appraisal conclusion will be failed.

Article 20 The agricultural machinery appraisal agency shall issue a promotion appraisal report to the applicant within 15 days from the date of completion of the appraisal. If the applicant confirms that there is no objection and the promotion appraisal conclusion is passed, it shall be reported to the corresponding agricultural mechanization administrative department of the corresponding people's government for approval and issuance of a promotion appraisal certificate in accordance with regulations.

If the applicant has objections to the appraisal results, he or she may apply for a re-inspection to the agricultural machinery appraisal agency that issued the report within 15 days from the date of receipt of the promotion appraisal report. The re-inspection costs shall be borne by the responsible party.

The General Station of Agricultural Machinery Testing and Appraisal of the Ministry of Agriculture is responsible for the review of ministerial-level promotion appraisal reports and other materials. It should complete the review within 15 days from the date of receipt of the materials, and submit the summary of the review to the Ministry of Agriculture for approval and issuance. certificate.

Article 21 The administrative departments of agricultural mechanization of the people's governments at or above the provincial level shall announce in the form of announcements the products and enterprises that have been approved for promotion and appraisal, and publish relevant information on designated media to promote the principles of appraisal and announcement. Published once every quarter. Agricultural machinery appraisal institutions shall publish corresponding test results at the same time. Applicants must obtain the promotion appraisal certificate and order the special logo from the accepting agency within 10 days after the announcement.

Chapter 5 Changes and Cancellations

Article 22 During the validity period of the promotion appraisal certificate, if the certificate information, product structure type, production conditions, etc. change, the certificate holder shall Submit a written report and relevant supporting materials to the original promotion appraisal acceptance agency within 1 month.

The accepting agency will provide handling opinions based on the report. If the conditions for certificate change are met, the enterprise shall be notified to apply for certificate change. If the product structure type and production conditions undergo major changes, the enterprise shall be notified to re-apply for promotion appraisal.

When an enterprise applies for a certificate change or re-applies for a promotion appraisal, it must return the original certificate at the same time.

Article 23 After reviewing and verifying the application for certificate change, the agricultural machinery appraisal agency shall report it to the agricultural mechanization administrative department of the affiliated people's government for approval of the certificate change. According to relevant written materials, if it is determined that the information applied for change does not involve changes in product structure type and production conditions, the certificate change can be submitted directly; if it cannot be determined, product consistency confirmation and production condition review should be carried out.

After confirmation and review, if the product structure type has not changed, but the production conditions have changed but the requirements are met, the certificate can be submitted for change; if the product structure type has changed significantly, or the production conditions have changed and the requirements are not met, the certificate will not be changed.

Article 24 Products and enterprises that have been approved to change their promotion certificates shall be announced in accordance with the relevant provisions of Article 21 of these Measures. The changed certificate should also indicate the relevant content before the change and the date of replacement. The original certificate number and validity period remain unchanged.

Article 25 If a product or enterprise that has obtained a promotion appraisal certificate is found to have any of the following circumstances during the validity period of the certificate, its certificate will be revoked with approval and an announcement will be made:

(1) Major quality problems or concentrated quality complaints occur in the product, but the producer fails to resolve them within the prescribed time limit;

(2) The relevant content of the certificate has changed and no application for certificate change has been made;

(3) The certificate shall not be changed in accordance with Article 23 of these Measures;

(4) There are serious quality problems during national product quality supervision and inspection or market quality supervision and inspection. ;

(5) The product is included in the catalog of products that are explicitly eliminated or prohibited from production by the state;

(6) Fraud, fraud, bribery and other improper means are used to obtain appraisal results or certificates

(7) Renting, lending, altering, fraudulently using or transferring the promotion appraisal certificate, or using the special mark for promotion appraisal not in accordance with regulations or beyond the scope;

(8) When an intellectual property dispute arises about a product, the people's court decides that the certificate holder has infringed the certificate and the judgment has come into effect;

(9) Supervision and inspection results show that there are serious defects in the factory's production conditions, or there are serious problems with product consistency;

(10) Refusal to accept or cooperate with supervision and inspection, if the circumstances are serious;

(11) Other circumstances under which the certificate should be revoked.

Chapter 6 Supervision and Management

Article 26 The administrative departments of agricultural mechanization of the people's governments at or above the provincial level shall organize supervision and inspection of enterprises and products that have passed the promotion appraisal. Supervision and inspection contents include:

(1) Inspection of production conditions;

(2) Inspection of company name, address and product consistency;

(3) Certificate and flag usage checks.

Article 27 The administrative departments of agricultural mechanization of the people's governments at or above the provincial level shall strengthen the supervision of the promotion and appraisal work and establish a quality feedback system for the promotion and appraisal work. Within 7 days after the completion of the promotion and appraisal work, the applicant enterprise shall fill in the "Feedback Form on the Promotion and Appraisal Work" (see Appendix 2) and report accordingly to the Agricultural Mechanization Management Department of the Ministry of Agriculture or the agricultural mechanization administrative department of the provincial people's government.

Article 28 Agricultural machinery identification agencies shall strengthen the education and supervision of their own staff, and at the same time accept the supervision of enterprises and society. If promotion appraisal inspectors and examiners are reported and complained, the agricultural machinery appraisal institution where they work shall investigate and verify the reported violations within 3 months. If it is verified to be true and the circumstances are serious, their promotion appraisal inspectors and examiners shall be cancelled. examiner qualifications and impose administrative sanctions in accordance with the law.

Article 29: Extension appraisal inspectors shall be trained and assessed on relevant regulations, technical specifications, test methods and instrument operation methods by the agricultural machinery appraisal institution where they work. Only those who pass the test may engage in extension appraisal Work. The promotion appraisal inspector shall be an on-the-job employee of the unit to which he/she belongs. Agricultural machinery appraisal institutions shall promptly submit the list of qualified extension appraisal inspectors to the Ministry of Agriculture or the administrative department of agricultural mechanization of the provincial people's government for record after the training and assessment.

Article 30 The Agricultural Machinery Testing and Appraisal Station of the Ministry of Agriculture is responsible for the training and assessment of examiners responsible for ministerial-level promotion and appraisal work. The examiners responsible for the provincial promotion appraisal work are trained and assessed by the agricultural machinery appraisal institution where they work. Only those who pass the examination can engage in the review and supervision of the production conditions for extension appraisal.

Article 31 Promotion appraisal examiners shall meet the following conditions:

(1) Have a bachelor’s degree or above or an intermediate professional and technical title or above;

(2) Familiar with the production process, product standards and quality management system standards of relevant agricultural machinery products;

(3) Engaged in relevant work for more than 4 years.

Article 32 Agricultural machinery appraisal institutions shall establish a standardized archives management system and completely preserve promotion appraisal work records and related materials. The archives shall be kept for at least 5 years.

Chapter 7 Supplementary Provisions

Article 33 The term “day” as mentioned in these Measures refers to working days.

Article 34 The Agricultural Mechanization Management Department of the Ministry of Agriculture may modify and improve the content and format of the attachment according to work needs.

Article 35 These Measures will come into effect on October 1, 2010. The "Implementation Measures for Agricultural Machinery Ministerial Promotion Appraisal (Trial)" (Agricultural Machinery Development [2007] ]1) shall be abolished at the same time.
