Why is the trademark registration cycle so long?

1. Trademark inquiry and data submission before trademark registration: about 6 working days

Checking whether the trademark is the same or similar is an essential step before applying for trademark registration. However, many people will ask: Check the trademark and prepare information. Does this also take about 6 days? The first thing to note is that the trademark search is to avoid being similar or even identical to others or registered trademarks. If you find that this happens to the trademark you applied for during the query, the applicant still needs to modify your trademark. The time spent increases naturally. Therefore, the trademark search and data submission will take about 6 days.

2. Notice of acceptance: 2-4 months

It takes about 2-4 months for the Trademark Office to issue a notice of acceptance. Receive a notification indicating that the trademark has entered the review stage. It just means that the Trademark Office has accepted your application. It does not mean that the trademark registration is successful. Related review will be carried out next. At this time, the trademark cannot be used freely.

3. Review cycle: 9 months

The Trademark Law stipulates that the trademark review cycle is 9 months, but the State Intellectual Property Office has stated that it hopes to shorten the review cycle to 9 months by the end of this year. 6 months. It has been shortened to 7 months now. The review cycle is to check the applicant's application materials and the content of the materials to see if they meet the review conditions. At the same time, it will also be reviewed whether the applied for registered trademarks are identical or similar. If the appeal conditions are not met, the application will be rejected. If it is met, the application will naturally proceed to the next process.

4. Announcement period: 3 months

For a trademark that has been initially approved, there will be a period of three months from the publication of the preliminary approval announcement. If an enterprise or individual raises an objection during the announcement period, the trademark objection defense and other procedures will also need to be conducted.

5. Obtain certificate of trademark registration

When no unit or individual raises any objection during the announcement period, the Trademark Office will approve the trademark registration after the announcement period ends. It still takes a short period of time from the time the certificate is issued to the time it is received, but compared to the previous steps. I believe the final wait will be a piece of cake.
