Thank you for using the Battle.net service (referred to as the "Battle.net Service"). These terms of use (referred to as "TOU" or "these terms") are a legal agreement between you and Shanghai Netzhiyi Network Technology Development Co., Ltd., and stipulate that: on the premise of complying with the provisions of these terms, you will have the right to use the strategy Internet services. Blizzard Entertainment, Inc., a corporation incorporated in the State of Delaware, U.S.A. (together with its affiliates and licensors, "Blizzard") is the copyright owner of the Battle.net Service. Shanghai NetEasy Network Technology Development Co., Ltd. has been designated by Blizzard as the independent and exclusive licensee of the Battle.net service in the People's Republic of China (excluding Taiwan, Hong Kong Special Administrative Region and Macau Special Administrative Region). Shanghai NetEase Network Technology Development Co., Ltd. is an affiliated company of NetEase (NetEase.com, Inc.). For convenience, Shanghai NetEase Network Technology Development Co., Ltd. is referred to as "NetEase" or "we" for short. These Terms do not replace the End User License Agreement ("EULA") contained in Blizzard's games ("Games"), nor do they replace the effectiveness of other game-specific Terms of Use. The EULA is the agreement that governs your use of the game client (the part of the game program installed on your computer), and these Terms are the agreement that governs your use of the Battle.net service.

Grant a limited license to use the Battle.net Service. You must agree to and abide by the terms of these Terms before you can use the Battle.net service by using a web browser or an officially approved game client that has not been modified without authorization. You may only use the Battle.net service for non-commercial entertainment purposes and may not use the Battle.net service for other purposes or by other means.

Additional licensing restrictions. The license granted to you in Section 1 will be subject to the restrictions set forth in Sections 1 and 2 (collectively, the "License Restrictions"). Any violation of license restrictions when using Battle.net services or games will be considered an infringement of Blizzard's game copyrights. You agree that under no circumstances will you:

Use cheats, bots, hacks, mods or other unauthorized Authorized third-party software to modify the Battle.net service, modify the game, or interfere with the game experience;

Use the Battle.net service or game or any content contained therein for commercial gain, including but not limited to (a) without Conduct such activities in Internet cafes, computer game centers or other commercial venues with the written consent of NetEase and/or Blizzard; (b) spread or assist in the spread of commercial advertisements or carry out similar instigation; (c) without the consent of NetEase and/or Blizzard / Or authorized by Blizzard to collect game currency, items or resources for offline sale; or (d) collect rewards offline by providing online services, such as power-leveling;

Use unauthorized third party Third-party software (including, but not limited to, any software that reads memory areas used by games or Battle.net Services to store information about game characters or game environments) intercepts, mines, or otherwise removes data from the Game or Battle.net Services or through Games or Battle.net services collect information; however, NetEase and/or Blizzard have the right to independently decide whether to allow you to use certain third-party user interfaces;

By any method not expressly approved by NetEase and/or Blizzard , modify any component files of the game or Battle.net service or cause the aforementioned files to be modified;

Use any means to host, provide or develop matching services for Blizzard games or Battle.net services for a certain purpose, Or intercept, imitate or redirect the communication protocols used by Blizzard and/or NetEase, including but not limited to conducting unauthorized gaming activities through the Internet, online battles or content aggregation networks;

Assist , create or maintain any unauthorized connection to the Game or Battle.net Services, including, but not limited to: (a) any connection to any unauthorized server that imitates or attempts to imitate the Battle.net Service or Game; and ( b) Use any connection with programs or tools that are not expressly approved by Blizzard and/or NetEase; or

interfere with or assist in interfering with (i) any computer used to provide Battle.net services or game services (referred to as "Server"); or (ii) other players play normally.

Any attempt to interfere with Battle.net services or disrupt the normal operation of the game may violate criminal and civil laws.

Reverse engineer, decompile, or disassemble the Game or Battle.net Services for any purpose.

Required. Before using the Battle.net Services, you must (i) agree to these Terms, the Privacy Policy, and the applicable Terms of Use, End User License Agreement, and In-Game Policies for each game on the Battle.net Services ; (ii) purchase a valid license for the game that will use the Battle.net Service; and (iii) register a pass in the Battle.net Service (referred to as a "Battle.net Pass"). You are responsible for paying Internet network fees and other charges incurred when using Battle.net services. The use of Battle.net services by minors will be subject to the relevant laws, regulations, rules and policies of the People's Republic of China (including but not limited to restrictions on game anti-addiction and real-name authentication).

Get services.

Pass qualification. You must be a "natural person" to create a Battle.net Pass. No company, limited liability company, partnership, or other legal or business entity may create a Battle.net Pass. Individuals who have been banned from using Battle.net services by Blizzard or NetEase are not allowed to create or use Battle.net passes, otherwise they may be subject to severe civil and criminal penalties. By accepting these terms, you hereby guarantee that you meet the aforementioned prerequisites for creating a pass.

Create a pass. When creating or updating a Battle.net Pass on the Battle.net Service, you will need to provide NetEase with certain personal information, such as your name, address, phone number, email address and, in some cases, payment information. For some games (the specific scope of application is determined independently by NetEase and Blizzard), when adding a game license to a pass, you need to use an unused activation code provided by NetEase. In this case, you must add a game license to your Battle.net Pass before you can start playing online. You hereby agree that you will provide accurate and complete information and promptly update the information provided if the information changes. When you apply to bind a game account to a Battle.net pass, we will ask you to provide true and valid identity information or relevant documents so that we can check and confirm that you are a legitimate user who has registered a game account and determine game account activities. Legality, legitimacy and rationality.

Username and password. During the Battle.net Pass creation process, you will be asked to select a unique username and/or password (collectively, the "Login Information"); you may not use one with anyone other than those expressly designated in this section. Battle.net pass or login information. You are obligated to keep your login information confidential and are responsible for all actions (including transactions) conducted using this login information, regardless of whether the actions are authorized by you.

Notification. If you discover or reasonably suspect that there is a vulnerability in the security of your login information (including but not limited to login information being lost, stolen, or disclosed without permission), you must immediately notify us by sending an email (email address: /support) .

Suspension or cancellation of Battle.net Pass. Blizzard and/or NetEase may in certain circumstances (such as violation of this Agreement, a game's end user license agreement or other policies of NetEase and/or Blizzard, or in order for NetEase and/or Blizzard to comply with applicable laws issued by local governments or Temporarily suspend, permanently suspend, modify or delete the Battle.net Pass under the Act). In particular, during the process of binding a game account to a Battle.net pass, Blizzard and/or NetEase believe that the game account you requested to be bound is suspected of fraud, misrepresentation, violation of these terms, inappropriate behavior, or dishonesty. Whether you unilaterally terminate this Agreement early or NetEase terminates this Agreement early due to your violation of these Terms of Use or other NetEase or Blizzard Entertainment policies, you hereby make an irrevocable commitment: upon the termination of these Terms of Use From now on, you will use all the prepayment and remaining game time in your account as liquidated damages to compensate NetEase for such breach of contract. Protocol. This Agreement will be continuously updated while improving the service. Software and Services. In order to improve the quality of our products and services, we may ask you to download and install updates to the games and Battle.net services that are installed on your computer. You acknowledge and agree that we may update the Battle.net Services and games (including game clients stored on your computer) at any time, with or without prior notice to you.

Ownership.

Game clients and Battle.net services. Game clients and Battle.net services (including but not limited to any subtitles, computer code, themes, objects, game characters, game character names, story content, dialogue content, catchphrases, game concepts, artwork, animations, sound effects, music, The copyrights for audio and video effects, calculation methods, personality rights, documents, copies of online chat records, game character profile information, game time recorded using the client, and game client and server software) belong to Blizzard and are licensed to NetEase. User and game data. Your personal data, account data and all other related information, including the game characters and goods in your account, are owned by Blizzard and/or NetEase. You hereby agree and confirm that the provision, disclosure or transfer of such data will be further stipulated in the Privacy Policy.

Virtual items. All content appearing in Blizzard or NetEase Battle.net services and games has ownership, licensing or other rights. You agree that you have no ownership rights or any other rights in the aforementioned content (including but not limited to virtual items and currencies that appear or are generated in the game, and other attribute information associated with the pass or stored in the Battle.net service).

We do not recognize any so-called transfer of virtual property outside the game, nor do we recognize any so-called sales, gifts or transactions of content appearing or generated in the game in the "real world", unless the above actions have been approved by NetEase and/or Blizzard’s express written authorization. Therefore, you may not sell in-game items or currency in exchange for "real-world" currency, or exchange such items and currencies with equivalent real-world items outside the game, unless you have obtained written permission from NetEase and/or Blizzard.

Fees. You hereby agree to pay all fees and taxes incurred as a result of your or others' use of your registered Battle.net Pass. If you choose the automatic renewal payment method for any game, you agree that the relevant fees will be automatically deducted (i.e., the fees will be deducted from your account or credited to your credit card account). Fees for goods and services provided by the Battle.net Service may be adjusted at any time, including but not limited to subscription fees for any games. You acknowledge that you are not entitled to a refund of any prepayments made on behalf of the Battle.net Pass.

Transfer of Game License.

Based on the independent decisions of NetEase and Blizzard, some game clients may require an activation code. The activation code that matches the game client can only be used once, and will cause the Battle.net account registered with the activation code to obtain a license for the corresponding game. The transferability of the game client license will be subject to the provisions of the game's End User License Agreement; however, any transfer of the game client will not have any impact on your registered Battle.net Pass. Restrictions and Conditions of Use

Must not violate legal requirements. You agree that you will not violate any applicable laws and regulations when using the game client or Battle.net services. Without limiting the foregoing, you will not use the Battle.net service to provide any materials or information that may infringe third party copyrights, trademark rights, patent rights, trade secrets or other rights (including personal privacy rights and publicity rights).

Abuse of the Service. You may not connect to or use the Battle.net Services in any manner not expressly permitted by this Agreement. Without limiting the foregoing, you agree not to initiate, assist, or participate in any form of attack, including but not limited to (a) attacking Battle.net services, attempting to interrupt Battle.net services, or hindering others from normal use of Battle.net services; (b) attempting to Use Battle.net services, Battle.net passes registered by others, or enter computer systems or networks associated with Battle.net services without authorization.

No data collection is allowed. You agree not to (a) obtain or attempt to obtain information from the Battle.net service or any game in any manner not expressly permitted by NetEase and/or Blizzard; (b) intercept, view or observe any information provided by the client or the Battle.net service Proprietary communications protocols used, whether through the use of network analyzers, packet eavesdroppers, or other devices; (c) use of any third-party software to collect information from/through the game client or Battle.net services, including but not limited to your character information , any Battle.net pass information, virtual item information, other player information or all other game data you registered.

User Content. "User-related content" refers to any communications, images, sounds and all materials and information uploaded or transmitted by you or other users through the game client or Battle.net services, including but not limited to any chat records. You hereby grant Blizzard and NetEase a perpetual, irrevocable, worldwide, paid-up, non-exclusive license, including the right to sublicense to third parties, to reproduce, correct, adapt, modify, translate, and reorganize , create derivative works, manufacture, introduce into circulation, publish, distribute, sell, license, transfer, rent, lease, transmit, publicly display, publicly perform, provide electronic access interface, broadcast, communicate to the public through communication means, display, perform, Enter into computer memory, use and implement such User Content and all modified and derivative works based thereon. You acknowledge that you have no expectation of privacy with respect to any User Content (including but not limited to chat text or voice communications). We assume no responsibility or liability for user-generated User Content. We have the right (but not the obligation) to edit, refuse to post or remove any User Content in our sole discretion. We also reserve the right to decide at any time whether to disclose any user content and other information (including but not limited to chat text, voice communication information, IP addresses and user personal information), (a) in order to comply with any applicable laws, regulations, legal procedures or Government requests; (b) to enforce these Terms, any agreement or Blizzard/NetEase related policies; (c) to protect our legal rights and obtain relief; (d) when we believe that someone's health or safety may be threatened; or (e) to report a crime or other misconduct.

Disclaimer. To the maximum extent permitted by applicable law, the Battle.net Services are provided for your use on an "as is" and "as available" basis without warranties of any kind (whether express or implied), including but not limited to merchantability, fitness for a particular purpose. suitability, title, non-infringement, and various possibilities arising from customary dealings and trade practices. NetEase and Blizzard do not guarantee that you can access or use the Battle.net service at the time and place you choose; do not guarantee that the Battle.net service will not be interrupted or error-free; do not guarantee that defects will be corrected; and do not guarantee that the game client and Battle.net The Services are free of viruses or other harmful elements.

Scope of liability; sole and exclusive method of compensation; compensation

Blizzard and NetEase are not responsible for any losses caused by your use of Battle.net services or your inability to use Battle.net services. . Under no circumstances will Blizzard and/or NetEase be liable for special, incidental, indirect, punitive or consequential damages arising out of your use of the Battle.net service, any game, or any game client. For any claims or demands made by a third party due to your use of the Battle.net service or any game, violation of these Terms, violation of the Code of Conduct, or violation of the End User License Agreement of any game, You agree to indemnify, defend and ensure that the interests of Blizzard and NetEase are not infringed upon in the event of damages or other losses (including payment of reasonable attorneys' fees).

Dispute Resolution and Governing Law.

Disputes are expensive and time-consuming for all parties. In order to shorten the resolution time and reduce the cost of resolution, for any disputes, controversies or claims (collectively, "Disputes") regarding these Terms of Use, you and NetEase have agreed that before submitting to arbitration or litigation, the parties will first resolve any dispute. (Except for disputes expressly listed below) conduct informal negotiations for at least (30) days. The parties will commence negotiations from the time of writing from either party.

Binding Arbitration. If the parties are unable to resolve the dispute through negotiation (excluding the exception disputes expressly listed below), you and NetEase agree to initiate arbitration. The parties agree that the China International Economic and Trade Arbitration Commission ("CIETAC") shall conduct arbitration in Beijing, China in accordance with CIETAC's effective arbitration rules and applicable laws. The arbitration award is final and binding on all parties. Your arbitration fees and your share of arbitration compensation shall be borne by you personally.

Restrictions. You and NetEase agree that any arbitration shall only apply to disputes between NetEase and you personally. You acknowledge and agree that (1) no other person will be implicated in any arbitration; (2) there is no right or authority to conduct a contractual arbitration or to use the procedures of a contractual arbitration; and (3) there is no right or authority to represent Disputes brought by the public or other persons on behalf of the presumed parties.

Exceptions to Negotiation and Arbitration. You and NetEase agree that the following disputes will not be subject to the above negotiation and binding arbitration provisions: (1) any disputes seeking to enforce or protect your or NetEase’s or Blizzard’s intellectual property rights or related to the validity of intellectual property rights; (2) any disputes related to theft, Disputes involving piracy, privacy infringement or unauthorized use, or arising out of these circumstances; and (3) requests to lift the injunction.

Such disputes shall be handled by the people's court with jurisdiction where NetEase is located, and you and NetEase agree to submit such disputes to such court for adjudication.

Applicable law. Unless expressly stated otherwise, these Terms shall be governed by the laws of the People's Republic of China, and the choice of law principle shall not apply. The United Nations Convention on the Law of the International Sale of Goods is expressly excluded from application to these Terms.

General Terms

Modification of Terms of Use. The Terms of Use may only be modified in writing signed by NetEase and/or Blizzard or published by NetEase on the official Battle.net website.

Transfer. NetEase may assign these Terms, in whole or in part, to any individual or entity at any time, with or without your consent. You may not transfer your rights and obligations under these Terms without NetEase's prior written consent; any unauthorized transfer is invalid.

Severability of Terms. If any part of these Terms is held to be invalid or unenforceable, that part will be removed and the remaining parts will maintain full legal effect.

Attorney fees. No matter which party initiates a lawsuit related to the Terms of Use, the winning party shall have the right to require that party to compensate the party for its reasonable expenses, attorney's fees and other expenses incurred in connection with the lawsuit.

The entire agreement. These Terms (including documents expressly referenced in these Terms) constitute the entire agreement between you and us and supersede all prior or contemporaneous content (whether electronic, oral or written) related to the Battle.net Service. , but these Terms shall coexist with the Blizzard Game End User License Agreement and cannot replace the game's End User License Agreement and game-specific Terms of Use.

No waiver. Our failure to enforce any provision of the Terms of Use shall not be construed as a waiver of current or future rights with respect to such provision nor shall it affect the right of either party at a later time to enforce such provision. Our express waiver of a provision, condition or requirement in the Terms of Use shall not constitute a waiver of any future liability consistent with such provision, condition or requirement.

Force majeure. NetEase and/or Blizzard shall not be responsible for any delays or errors caused by reasons beyond the reasonable control of NetEase and/or Blizzard, including but not limited to unforeseen circumstances or reasons beyond the control of NetEase and/or Blizzard. Unenforceable circumstances such as force majeure, war, terrorism, riot, embargo, civil or military events, fire, flood, accident, strike or shortage of transportation facilities, network interruption, shortage of fuel, energy, labor or materials.
