Object of trademark rights

The objects of trademark rights include:

1. General trademarks. It mainly includes text, graphics, letters, numbers, three-dimensional logos, color combinations and sounds, etc., as well as combinations of the above elements, and must be registered in accordance with the law;

2. Well-known trademarks. It must meet the conditions of being well-known to the public, having a certain period of use, and having a record of being protected as a well-known trademark, and registration is not a necessary condition for protection;

3. Other objects.

Legal Basis

Article 8 of the "Regulations on the Implementation of the Trademark Law of the People's Republic of China"

Any product that can be used by a natural person, legal person or other organization Marks that distinguish them from others' goods, including words, graphics, letters, numbers, three-dimensional signs, color combinations and sounds, etc., as well as combinations of the above elements, can be applied for registration as trademarks.

Article 14

Well-known trademarks shall be determined at the request of the parties as facts that need to be determined in handling trademark cases. The following factors should be considered in determining a well-known trademark:

(1) The degree of awareness of the trademark by the relevant public;

(2) The duration of use of the trademark;

(3) The duration, extent and geographical scope of any publicity work for the trademark;

(4) The record of the trademark being protected as a well-known trademark;

(5) The Other factors that make a trademark famous.
