Do I need to take an oath after applying for a trademark in the Philippines? When shall we take the oath?
Yes, trademark registration in the Philippines requires two use oaths. The first time is to submit a three-year use statement within three years after the trademark application (counting from the date of application), and the second time is to submit a five-to six-year use statement after the registration (counting from the date of registration). Please note that the starting date of submission of the two use evidences is different. Submitting the use oath twice requires the applicant to provide 3-5 pictures of the actual use of the trademark on the designated goods/services in the Philippines, and provide relevant information on the use of the goods/services in the Philippines.
