Article 123 Civil subjects enjoy intellectual property rights in accordance with the law.

Intellectual property rights are the exclusive rights enjoyed by obligees in accordance with the law with respect to the following objects:

(3) Trademark;

(4) Geographical indication;

(5) Trade secret;

(7) New plant varieties;

(8) Other objects specified by law.

Article 444: Where property rights in intellectual property rights such as registered trademark rights, patent rights, copyrights, etc. are pledged, the right to pledge shall be established when the pledge is registered.

After the property rights in intellectual property rights are pledged, the pledgor shall not transfer or permit others to use them, unless the pledgor and the pledgee agree through negotiation. The price obtained by the pledgor from transferring or permitting others to use the property rights in the pledged intellectual property rights shall be paid off the debt in advance or deposited to the pledgee.

Article 600: When a subject matter with intellectual property rights is sold, the intellectual property rights of the subject matter do not belong to the buyer, unless otherwise provided by law or otherwise agreed by the parties.
