Distinctiveness refers to the attributes of a trademark that indicate the source of a company’s goods or services and distinguish them from those of other companies. So what does the distinctiveness of a trademark include?

The determination of trademark distinctiveness should take into account the particularity of the specific trademark.

According to the basic requirements for trademark distinctiveness, the following words and graphics do not have the distinctiveness of a trademark:

① The trademark text, graphics, letters, numbers, three-dimensional logos, color combinations, or a combination of the above elements are loosely combined, and Cannot form a whole;

② The expressive content of each component of the trademark text, graphics, letters, numbers, three-dimensional logos, color combinations, or a combination of the above elements is difficult to connect, and lacks a distinctive part.
