Second, the process
1. Inquiry before trademark registration application: This process takes 1 day, because the trademark registrant will inquire about the designed trademark to see if there are the same or similar trademarks before applying for a trademark. There are nearly several million trademarks in China, and it is also a very time-consuming project to check them one by one, so it will take a whole day. I suggest you go to a professional trademark agency or directly to the Trademark Office for enquiry.
2. Trademark form review: After the trademark application is submitted, the Trademark Office will conduct a formal review. The process of formal examination takes about one month. In this process, it is necessary to conduct a preliminary review of whether the application materials, documents and procedures comply with the legal provisions. After the review, an acceptance notice will be issued and the application date will be set for the registrant. Once the application date is determined, it becomes the legal basis for determining the trademark right. The date of application for trademark registration shall be the date when the Trademark Office receives the application.
3. substantive examination of trademarks: the time required for substantive examination is about 9 months, and if all goes well, it may be shorter. The main content of the examination is to check, analyze and compare the materials submitted for trademark registration, conduct research and decide whether to give a preliminary examination or reject the application.
4. Announcement of preliminary examination of trademark registration: Announcement of preliminary examination shall be issued within three months after the completion of substantive examination. This announcement is issued to let everyone put forward their own opinions on this trademark. If no one raises an objection within these three months, the Trademark Office will allow the registered trademark submitted by the applicant to register, issue a registration announcement and issue a registration certificate.
