Article 15
The basic people's courts may First-instance criminal cases that are sentenced to life imprisonment or death shall be transferred to the Intermediate People's Court for trial. The basic people's courts may request to transfer the following first-instance criminal cases to the intermediate people's courts for trial: (1) Major and complex cases; (2) New types of difficult cases; (3) Cases with general guiding significance in the application of law.
If a case needs to be transferred to the Intermediate People's Court for trial, a written request for transfer should be made no later than fifteen days before the expiration of the trial period of the case after submitting the decision to the president. The Intermediate People's Court shall make a decision within ten days after receiving the application. If the person disagrees with the transfer, a decision not to agree to the transfer shall be issued, and the people's court requesting the transfer shall try the case in accordance with the law; if the transfer is agreed, a decision agreeing to the transfer shall be issued and the People's Procuratorate at the same level shall be notified in writing.
