1. The scope of reference is different. Logo design is a general term and a general term. All graphic symbols and text symbols with specific meanings can be called logos.
Trademark design is: a sign used in the commercial field with commercial purpose and commercial value. The use of a logo on goods or product packaging is called a trademark, which is subject to legal registration and is protected by law. It is a type of logo design.
2. Obtaining rights Different signs (logos) do not need to be registered as works of art. Copyrights are automatically obtained upon completion of the design. A trademark must be registered by the corresponding state agency to obtain trademark rights.
3. Different rights ownership
The designer and owner of the logo are probably not the same person. A company has to entrust a designer to design a logo. As a commissioned work, there are two situations in which the copyright of the logo belongs:
(1) It is agreed that it belongs to the client;
(2) There is no agreement and it belongs to the designer. Trademarks belong only to the trademark owner and are intellectual property rights.
4. Legal protection: Different signs (logos) are protected by the "Copyright Law"; trademarks are protected by the "Trademark Law". A logo can be registered as a trademark.
This trademark is protected by both the Copyright Law and the Trademark Law, which means that the scope of protection for logos and trademarks is different. The scope of protection for logos is not as broad as that for trademarks. If it is infringed, the degree of protection is also different. Trademarks are protected more strongly than logos.
For example: The copyright of a logo belongs to the designer. If the logo is infringed, it actually harms the interests of the owner of the logo, but only the designer has the right to sue. The trademark owner can directly sue for infringement in his own name.
5. Different periods of protection. The period of protection for logos as works of art is generally 50 years. The protection period of a trademark after registration is 10 years and can be renewed indefinitely.
