Alibaba released the annual report on intellectual property protection in 2020; Alibaba's intellectual property protection platform stipulates that Taobao sellers are obliged to ensure that the products they sell do not infringe the intellectual property rights of others. Sellers shall not sell counterfeit or pirated goods, and shall not publish information that intentionally misleads consumers. For example, they deliberately cover up or blur the pictures on the trademark, or are highly similar to the original brand.
In Taobao's Detailed Rules for the Implementation of Improper Use of Others' Rights, the infringement of merchants is explained as follows:
(1) "Goods or information released by the seller" includes but is not limited to goods, commodity information, store name, domain name, etc.
(2) Improper use of another person's trademark right means that the goods sold by the seller are recognized as trademark infringement, but they are not counterfeit;
(3) When using the copyright of others, it means that the goods sold by the seller are found to be infringing the copyright, but not pirated;
