Legal analysis: the name can be heavy, but there are other conditions. First, if you are not from the same industry, you can have the same name. Second, the name with the same name is not a well-known trademark. Third, the place where you registered the company and the place where you registered the same name are not in the same area. If the company name is duplicate, you can modify it and choose to re-register. However, it is not necessarily impossible to use the same company name. It depends on the jurisdiction, whether it is a well-known trademark and whether it has special protection. It shall not be the same as or similar to the name of a registered enterprise in the same industry within the jurisdiction of the registration authority; The industrial and commercial registration authorities in different provinces are different and can use the same name. Unless well-known trademarks can be protected across regions and categories, the names of other enterprises are limited to the jurisdiction of the registration authority and the corresponding categories for protection. The name composition of the two companies is the same, and they are in the same industry, which violates the principle that "the name of the application shall not be the same as the name of the peer enterprise approved or registered by the same administration for industry and commerce, except those with investment relationship", and it is likely that the name will not be pre-approved.

Article 2 The following enterprises with legal person qualifications shall register as legal persons in accordance with the provisions of these Regulations:

(1) Enterprises owned by the whole people;

(2) Enterprises under collective ownership;

(3) Joint ventures;

(4) Chinese-foreign equity joint ventures, Chinese-foreign cooperative ventures and foreign-funded enterprises established within the territory of People's Republic of China (PRC);

(5) private enterprises;

(six) other enterprises that need to be registered as legal persons according to law.

Article 7 An entity applying for the registration of an enterprise as a legal person shall meet the following conditions:

(1) Name, organization and articles of association;

(2) Fixed business premises and necessary facilities;

(3) Having funds and the number of employees that meet the requirements of the state and are commensurate with the scale of production, operation and service;

(4) Being able to bear civil liability independently;

(5) The business scope conforms to the provisions of national laws, regulations and policies.

Article 17 If an enterprise as a legal person changes its name, domicile, business place, legal representative, economic nature, business scope, mode of operation, registered capital and term of operation, or adds or cancels branches, it shall apply for registration of change.
