Article 2 Consumers as mentioned in these regulations refer to units and individuals who obtain goods or receive commercial services (hereinafter referred to as services) for a fee and directly use them for daily needs.
Producers and operators as mentioned in these regulations refer to units and individuals engaged in production and business activities and providing goods or services to consumers, including producers, sellers, and service providers. Article 3 Producers, operators and consumers within the province, as well as organizations and individuals legally responsible for protecting the legitimate rights and interests of consumers, shall abide by these regulations. Article 4: People's governments at all levels are responsible for organizing and implementing these Regulations, with the industrial and commercial administrative departments as the main body, and they will be implemented in conjunction with relevant departments.
Administrative departments such as industry and commerce, standards, metrology, pricing, health, commodity inspection, and quarantine should, in accordance with their respective responsibilities and cooperate with each other, seriously investigate and deal with the behavior of producers and operators that harm the legitimate rights and interests of consumers. Article 5: Judicial organs, competent departments of producers and operators, and relevant social groups are all responsible for protecting the legitimate rights and interests of consumers in accordance with the law. Article 6: News and public opinion organizations have the right to expose and criticize behaviors that harm the legitimate rights and interests of consumers in accordance with the law, and no unit or individual may interfere. Chapter 2 Consumer Rights and Obligations Article 7 Consumers enjoy the following rights:
(1) Supervise the goods and services provided by producers and operators, and make criticisms and suggestions.
(2) Free to purchase goods and choose services.
(3) Understand the real situation such as quality and price of goods and services.
(4) When purchasing goods and receiving services, obtain quality, measurement, safety, sanitation, price and other guarantees stipulated by the state or agreed with producers and operators.
(5) When purchasing goods and receiving services, ask for a unified industrial and commercial invoice or charging voucher.
(6) If the goods or services fail to meet the stipulated or agreed standards, you may be required to repair, replace, return or refund. If your property or person is damaged, you may be required to compensate for the loss.
(7) When legitimate rights and interests are harmed, the producer or operator has the right to complain to the superior authority or relevant administrative department or consumer association, or to file a lawsuit in the People's Court.
(8) Other rights enjoyed in accordance with the law or in accordance with agreements with producers and operators. Article 8 Consumers have the following obligations:
(1) Respect social ethics, take good care of the goods when purchasing them, and shall not damage the legitimate rights and interests of producers and operators.
(2) Comply with the order or regulations of the production and business premises and the agreed service system.
(3) Install, use and maintain your own products according to the instructions.
(4) When making complaints or lawsuits due to infringement of legitimate rights and interests, truthfully report the situation and provide relevant evidence in a timely manner. Chapter 3 Responsibilities of Producers and Operators Article 9 In the activities of providing goods or services to consumers, producers and operators must abide by relevant national laws and regulations, abide by professional ethics, and adhere to fairness, voluntariness, honesty, credit, and compensation of equal value. principles to ensure the quality of goods and services and not harm the legitimate rights and interests of consumers. Article 10 Producers and operators shall abide by the following regulations:
(1) Comply with national price policies and price management regulations, and discuss prices based on quality. They are not allowed to bully the market, raise prices without authorization, or raise prices in disguised form, except in farmers' markets. Except for some fresh and live products, prices should be clearly marked in accordance with regulations.
(2) The goods produced and sold must be accompanied by inspection certificates (including the name or code name of the inspector) and Chinese instructions for use according to different characteristics according to regulations, and the product name and manufacturer's name must be marked in Chinese. Name (font size), address, main ingredients, content, weight, performance, usage, production batch number, product technical standard number, etc. of the product. Products subject to grading must also indicate the quality level of the product. Among them, if they are used for a limited time, the production date and expiration date must be marked; electrical products must be accompanied by circuit diagrams; measuring instruments must be marked with the CMC logo.
(3) Industrial products that do not reach the level specified by the relevant national standards but still have use value must be approved by the competent authority of the enterprise and marked with "processed products" on a prominent position on the product or its packaging. After the words are written, the price can be reduced and sold.
(4) Products that violate national safety, health, environmental protection, measurement and other regulatory requirements must be destroyed in time or undergo necessary technical processing, otherwise they may not enter the market in any way. Disposed and discarded raw materials and parts shall not be used to produce and assemble products for sale.
(5) Products subject to the production license system and compulsory certification system must be marked with the number, approval date and validity period of the corresponding certificate. It is not allowed to produce or sell goods for which the country has implemented a production license system and a compulsory certification system but has not obtained the corresponding certificates upon expiration.
(6) It is not allowed to produce products that have been eliminated or banned by the state, and it is not allowed to sell expired, rotten, toxic and harmful products, and other products that may endanger personal safety and health.
(7) The content of product advertisements and service advertisements must be true and healthy. Advertisers and advertising operators are not allowed to make false advertisements or conduct other deceptive publicity to deceive or deceive consumers.
(8) It is not allowed to produce or sell goods that counterfeit registered trademarks or counterfeit registered trademarks of others, as well as goods that use quality marks, license marks or certification marks.
(9) It is not allowed to produce or sell obscene and other prohibited goods, and it is not allowed to engage in service activities prohibited by the state.
(10) Products with guaranteed repairs, replacements and returns must be fulfilled within the guarantee period. For imported durable consumer goods, the operators are responsible for guarantees of repairs, replacements and returns.
(11) It is not allowed to weigh less than a catty or less than an inch. It is not allowed to falsify measurement data. Stores and markets should set up fair scales and fair rulers.
(12) It is not allowed to adulterate with fakes, use inferior goods as good ones, use old ones as new ones, and it is not allowed to buy or sell goods by force or use deceptive or matching means to promote goods.
(13) When selling electrical appliances and other products that require calibration or testing, they must be calibrated and tested on the spot.
(14) When selling goods and providing services by receiving payment in advance or mail order, the quality and quantity must be guaranteed and the contract must be performed on schedule.
(15) There shall be no other violations of national and provincial laws and regulations on protecting the legitimate rights and interests of consumers.
