First, the state stipulates that those engaged in the production of special industrial products related to the safety of public life and property, scarce resources, etc. must obtain permission and obtain an industrial product production license before they can produce.

Second, enterprises engaged in food production must obtain a food production license. Those made in small workshops and sold on the spot are not included in this list.

Third, those who engage in food production and operation without obtaining a food production license shall, in accordance with Article 84 of the "Food Safety Law of the People's Republic of China 2010", be handled by the relevant competent authorities according to their respective division of responsibilities. Confiscate illegal gains, illegally produced and operated food, food additives, and tools, equipment, raw materials and other items used for illegal production and operation; if the value of illegally produced and operated food and food additives is less than 10,000 yuan, a fine of more than 2,000 yuan will be imposed. A fine of not more than 50,000 yuan will be imposed; if the value of the goods exceeds 10,000 yuan, a fine of not less than five times but not more than ten times the value of the goods will be imposed.
