Article 3 The term "individual industrial and commercial households" as mentioned in these Regulations refers to those who have been approved and registered in accordance with the law, whose production and operation capital is privately owned, who mainly engage in personal or family labor, and who engage in industry, commerce or other industries permitted by laws, regulations and rules for the purpose of profit. Individual industrial and commercial households can operate individually or as a family. If the business is run by an individual, the civil liability shall be borne by personal property; if the business is run by a family, the civil liability shall be borne by the family property. Article 4 The legitimate rights and interests of individual industrial and commercial households are protected by law and may not be infringed upon by any unit or individual.
Individual industrial and commercial households engaged in production and business activities should consciously abide by laws, regulations, rules and professional ethics, and accept the management of the people's government and its functional departments and the supervision of society. Article 5 People's governments at all levels should adhere to the policy of taking the public economy as the main body and the simultaneous development of various economic components and the principle of fair competition, and actively guide and support the development of individual economies. Article 6 The industrial and commercial administrative department of the autonomous region shall be responsible for the supervision and management of individual industrial and commercial households in the entire region; the industrial and commercial administrative departments of the municipal and county people's governments shall be responsible for the supervision and management of individual industrial and commercial households within their jurisdiction.
Relevant administrative departments shall provide guidance, services, supervision and management of the production and business activities of individual industrial and commercial households within their respective powers and in accordance with the law. Article 7 Individual workers' associations are mass organizations established by individual workers in accordance with the law and carry out activities in accordance with laws, regulations and the association's articles of association.
The Self-employed Workers Association, under the guidance of the industrial and commercial administration departments, assists the people's government and relevant state agencies in educating and managing self-employed workers; reflects the reasonable opinions and demands of individual workers, and safeguards its legitimate rights and interests and to provide services. Chapter 2 Registration Article 8 The following persons with full capacity for conduct may apply to engage in individual production and operation:
(1) Rural villagers;

(4) Unemployed personnel separated from government agencies, institutions and enterprise units;

Article 9 Citizens who apply to engage in individual industrial and commercial production and operation shall apply for registration with the local county-level industrial and commercial administration department with proof of identity. If laws, regulations and rules stipulate that production and operation require specific conditions or special approval, corresponding approval documents and certificates must also be submitted when applying for registration. Article 10 The main items for registration of individual industrial and commercial households include: trade name, name and address of the operator, number of employees, amount of capital, form of composition, production and business scope, business method, business address, etc. Article 11 The administrative department for industry and commerce shall, within thirty days from the date of accepting the application for registration, register and issue a business license to those who meet the conditions; for those who do not meet the conditions, they shall not register and notify the applicant in writing and state the reason.
The administrative department responsible for examining specific conditions and exercising special approval power in accordance with the law shall handle the application within fifteen days from the date of acceptance. Those that meet the conditions will be approved and an approval document will be issued; those that do not meet the conditions will be disapproved and the applicant will be notified in writing and the reasons will be stated. If laws, regulations and rules otherwise stipulate the time limit for review and approval, such provisions shall prevail. Article 12 Individual industrial and commercial households should go to the local tax authorities to handle tax registration within thirty days from the date of receiving their business license. Article 13 When an individual industrial and commercial household changes its trade name, production and business scope, business mode, business site and other major registration matters, it shall apply for change registration with the industrial and commercial administrative department where it was originally registered.
If changes require special approval, relevant procedures should be completed with the administrative department originally responsible for approval.
If an individual industrial and commercial household changes its operator, it must re-apply for registration. Article 14 If an individual industrial and commercial household cannot operate normally for more than one month and needs to suspend business, it shall apply for temporary suspension registration.
Any business that ceases business on its own initiative for more than six months will be deemed to have ceased business.
Article 15 If an individual industrial and commercial household goes out of business or terminates production and operation, it must go through the deregistration procedures with the industrial and commercial administrative department where it was originally registered thirty days in advance with proof of tax payment and settlement of claims and debts. Article 16 When the industrial and commercial administrative department handles change of registration, re-registration or cancellation of registration, it shall terminate the registration within thirty days from the date of receipt of the application. Article 17 If an individual industrial and commercial household loses its business license, it shall report to the industrial and commercial administrative department that originally issued the license, register the loss, and apply for a reissue. Failure to report or report loss will result in adverse consequences and the operator shall be held responsible. Article 18 Individual industrial and commercial households shall go through license verification procedures with the local industrial and commercial administrative department within the prescribed time limit every year. Chapter 3 Rights and Obligations Article 19 Individual industrial and commercial households shall enjoy the following rights in accordance with the law:
(1) The exclusive right to approve and register the name of the trade name;
