Article 2 These regulations shall apply to all units and individual businesses engaged in the production, processing, production, storage, transportation, and sales (hereinafter referred to as production and operation) of halal food within the administrative area of ??this city. Article 3 The term "halal food" as mentioned in these regulations refers to pastries, meals, dairy products, cold food, meat and meat products produced and operated according to the dietary customs of the people who eat halal food. Article 4: The Municipal Ethnic and Religious Affairs Committee is responsible for organizing and implementing these Regulations. Article 5 Units and self-employed households that produce and operate halal food must go to the ethnic affairs department of the county (city) or district people's government where they are located to go through the review procedures. After the relevant departments apply for certificates, they can receive the halal label.
Halal logos are produced by manufacturers designated by the Municipal Ethnic and Religious Affairs Commission. Article 6 Units and individual businesses that produce and operate halal food are not allowed to produce or operate foods that are forbidden by ethnic groups with halal dietary customs. Article 7 Units that produce and operate halal food should have more than 40% of ethnic employees with halal dietary customs. The person in charge and the personnel in major positions such as purchasing, storage, sales, production, and processing must be qualified by halal people. Ethnic minority citizens are responsible for the dietary customs.
Self-employed households that produce and operate halal food must be citizens of ethnic minorities with halal dietary customs. Article 8 Citizens of ethnic groups who do not have halal food customs are not allowed to contract, lease, or open halal food enterprises. Unapproved halal food enterprises and self-employed households are not allowed to hang plaques or flags with halal logos. Article 9 Units and individual businesses that produce and operate halal food must use special workshops, special equipment, special counters, special measuring instruments, special warehouses and special vehicles when producing, selling, storing, and transporting halal food.
Stalls selling halal food and stalls selling non-halal food must be separated. Article 10 The establishment of halal slaughter sites in cities, counties (cities) and districts shall be certified by the local ethnic affairs department. Cattle, sheep, poultry, etc. used for the production, operation, processing, and making of halal food must be slaughtered by the slaughterhouse at the halal slaughtering point and issued with a certificate.
Meat purchased by units and individual businesses that produce and operate halal food should indicate the source and attach valid certificates. Article 11 When enterprises and self-employed households that produce and operate halal food cease business, they shall return the halal label to the original issuing unit in addition to going through the procedures for closure or closure in accordance with regulations.
Halal signs may not be sublet or transferred.
If the halal logo is lost, mutilated or deformed, it should be reissued or replaced in time. Article 12: Advertising and promoting halal food, and printing various trademarks and packages with halal words or halal logos must be approved by the ethnic affairs department and relevant departments of the municipal, county (city), and district people's governments. Article 13 Anyone who violates these regulations and commits any of the following acts shall be punished by the ethnic affairs department of the county (city) or district people's government:
(1) Anyone who violates the provisions of Article 5 of these regulations shall be punished Units or individual businesses will be fined 500 to 1,000 yuan.
(2) Anyone who violates the provisions of Articles 6 and 8 of these Regulations shall have their halal logo confiscated, ordered to cease operations, and fined 500 to 1,000 yuan; if they belong to a unit, the unit supervisor shall be punished Leaders and those directly responsible are each fined 300 to 500 yuan.
(3) Those who violate the provisions of Article 7 of these Regulations shall have their halal labels confiscated and the unit or individual business owner shall be fined 300 to 500 yuan.
(4) Anyone who violates the provisions of Article 9 of these Regulations shall be fined 500 yuan for the unit and 200 yuan for the individual business owner.
(5) Anyone who violates the first paragraph of Article 10 of these Regulations shall be fined from 50 yuan to 200 yuan; whoever violates the second paragraph shall be fined from 50 yuan to 100 yuan.
(6) Anyone who violates the provisions of paragraph 2 of Article 11 of these Regulations shall have his or her illegal gains confiscated, his or her halal label confiscated, and a fine of 500 to 1,000 yuan be imposed; if the person belongs to a unit, the person in charge of the unit shall be punished and the person directly responsible shall each be fined 300 to 500 yuan.
(7) Anyone who violates the provisions of Article 12 of these Regulations shall be fined from RMB 200 to RMB 500. Article 14 If the violation of the provisions of these Regulations is serious, in addition to being punished in accordance with Article 13 of these Regulations, the industrial and commercial administration department shall order it to suspend business, conduct rectification, and even revoke its business license in accordance with the law. Article 15 Anyone who refuses or obstructs state functionaries from performing official duties, if the circumstances are serious, shall be punished by the public security organs in accordance with the provisions of the "Regulations on Public Security Administration Punishments of the People's Republic of China"; if a crime is constituted, criminal responsibility shall be pursued in accordance with the law. Article 16 Fines shall be issued using unified bills printed by the provincial finance department and handed over to the same level of finance. Article 17 If state agency staff members neglect their duties, abuse their power, or engage in malpractice for personal gain, they shall be subject to administrative sanctions by their units; if a crime is constituted, criminal liability shall be pursued in accordance with the law. Article 18 If the parties concerned are dissatisfied with the administrative penalty decision, they may file for reconsideration in accordance with the relevant provisions of the "Administrative Review Regulations" or directly file a lawsuit with the People's Court. If the party fails to apply for reconsideration within the time limit, does not file a lawsuit with the People's Court, and fails to implement the penalty decision, the department that made the penalty decision may apply to the People's Court for enforcement.
