Olympic Logo Registration and Management Measures

Article 1 In order to strengthen the protection of Olympic symbols, protect the legitimate rights and interests of Olympic symbol rights holders, and regulate the use of Olympic symbols, these Measures are formulated in accordance with the relevant provisions of the "Regulations on the Protection of Olympic Symbols". Article 2 The Olympic symbol rights holder shall apply to the Trademark Office of the State Administration for Industry and Commerce for recordation of the Olympic symbol that needs protection. Article 3 The Olympic logo rights holder may apply for trademark registration or logo use license registration directly to the Trademark Office, or may entrust a state-recognized organization with trademark agency qualifications to act as an agent. If you do not have a regular residence or business office in China, you should entrust an organization recognized by the state with trademark agency qualifications to act as an agent. Article 4 To apply for the registration of the Olympic emblem, an application form shall be filled in and the following documents shall be attached:

(1) 5 copies of the Olympic emblem. The pattern should be clear and easy to paste, printed on smooth and durable paper or replaced by a photo. The length and width should be no less than 10 cm and no less than 5 cm respectively.

(2) If entrusting another person to act as an agent, a power of attorney should be attached, indicating the entrusted matters and authority. Article 5 If the mark applied for registration complies with the Regulations on the Protection of Olympic Symbols and these Measures, the Trademark Office shall register it, notify the right holder in writing and make an announcement. If it does not meet the regulations, it will not be filed and the right holder will be notified in writing. Article 6 If the owner of the Olympic logo permits others to use the Olympic logo for commercial purposes, he shall sign a license contract. Article 7 The license contract for the use of Olympic logos shall include the following contents:

(1) The Olympic logos licensed for use and their registration numbers;

(2) The scope of goods or services licensed for use ;

(3) Geographical scope of licensed use;

(4) Licensed use period. Article 8 Within one month from the date of signing the license contract, the Olympic logo rights holder shall submit a copy of the license contract to the Trademark Office for filing. The Trademark Office will notify the right holder in writing after filing. Article 9 If the Olympic logo is used with permission, the license registration number shall be indicated when using it.

Anyone who violates the provisions of the preceding paragraph shall be ordered by the industrial and commercial administration authority at or above the county level to make corrections within a time limit; if the violation fails to make corrections within the time limit, a fine of not more than 10,000 yuan shall be imposed. Article 10 If the applicant is dissatisfied with the administrative decision of the Trademark Office regarding the filing of the Olympic logo or the filing of the logo license contract, he may apply for reconsideration to the State Administration for Industry and Commerce in accordance with the provisions of the "Administrative Reconsideration Law of the People's Republic of China"; You can also file a lawsuit with the People's Court in accordance with the relevant provisions of the Administrative Litigation Law of the People's Republic of China. Article 11 These Measures shall come into effect on June 1, 2002.
