Will trademark approximation be sentenced?

Legal analysis: Generally speaking, trademark approximation will not be sentenced, but it may be subject to administrative punishment. As far as the use of similar trademarks is concerned, trademark infringement is determined by the staff of the industrial and commercial bureau according to the actual words and patterns to confirm whether there is infringement or not. If the letters are different, but the same pattern may be similar, it can be defined as infringement of the exclusive right to use a registered trademark.

Legal basis: Article 57 of the Trademark Law of the People's Republic of China commits any of the following acts, which are infringement of the exclusive right to use a registered trademark: (1) using a trademark identical to its registered trademark on the same commodity without the permission of the trademark registrant; (2) using a trademark similar to its registered trademark on the same commodity or using a trademark identical to or similar to its registered trademark on similar commodities without the permission of the trademark registrant. 3) selling goods that infringe on the exclusive right to use a registered trademark; 4) forging or manufacturing another person's registered trademark logo without authorization or selling the forged or manufactured registered trademark logo without authorization; 5) changing the registered trademark of the trademark registrant and putting the goods with the changed trademark on the market without the consent of the trademark registrant. (6) Deliberately providing convenience for the infringement of the exclusive right to use a trademark of others and helping others to commit the infringement of the exclusive right to use a trademark; (7) Causing other damage to the exclusive right to use a registered trademark of others.
