Trademark is a sign used to identify and distinguish the source of goods or services. Any sign that can distinguish the goods of natural persons, legal persons or other organizations from the goods of others, including words, graphics, letters, numbers, three-dimensional signs, color combinations and sounds, and the combination of the above elements, can apply for registration as a trademark.
What is the main content of trademark right? The content of trademark right refers to the rights and obligations enjoyed by the trademark owner, including the exclusive right, prohibition right, transfer right, license right and renewal right of a registered trademark.
China's laws have made some specific provisions on the use of trademarks. If a natural person, legal person or other organization needs to obtain the goods it produces, manufactures, processes, selects or distributes, it shall file an application for the goods with the Trademark Office.
The use of trademarks mentioned in the Trademark Law and these Regulations includes the use of trademarks in commodities, commodity packages or containers, commodity trading documents, or in commercial activities such as advertisements and exhibitions.
Legal basis:
Article 22 of the Trademark Law of People's Republic of China (PRC) * * * An applicant for trademark registration shall fill in the category and name of the goods using the trademark in accordance with the prescribed commodity classification table and apply for registration.
An applicant for trademark registration may apply for the registration of the same trademark for many kinds of goods through one application.
Applications for trademark registration and other relevant documents may be submitted in written form or in the form of data messages.
Article 23 Where a registered trademark needs to obtain the exclusive right to use a trademark on goods outside the approved scope of use, a separate application for registration shall be filed.
