First, the conditions that an individual should have as a trademark applicant
1. If a natural person needs to obtain the exclusive right to use a trademark for goods or services produced, manufactured, processed, selected and distributed, he shall apply to the Trademark Office for trademark registration.
2. Two or more natural persons may apply to the Trademark Office for registration of the same trademark, and both parties shall enjoy and exercise the exclusive right to use the trademark.
Second, the conditions that a registered trademark needs to meet.
1. The trademark shall have legal elements.
Any visible sign that can distinguish the goods of natural persons, legal persons or other organizations from the goods of others, including words, graphics, letters, numbers, three-dimensional signs and color combinations, and the combination of the above elements, can apply for registration as a trademark. Trademarks, such as audio and smell, which cannot be perceived by vision, cannot be registered in China.
2. Trademarks should have distinctive features.
The distinctive features inherent in the logo itself, such as a trademark with novel concept and unique design, can be registered as a "second meaning" trademark if they are obtained through use, such as a narrative logo that directly describes the quality of goods and is easy to identify.
III. Materials to be submitted for individual registered trademarks
1. A copy of the applicant's ID card and the registration documents issued by the relevant administrative authorities. Passport holders need a copy of their passports.
2. Fill in the application for trademark registration (with fixed format) and sign it at the designated place.
3. There are six black-and-white patterns of trademarks, with clear patterns and specifications ranging from 5x5cm to 10x 10cm. If the color is specified, submit 6 color patterns with 1 black and white pattern.
4. Individual industrial and commercial households can apply for registered trademarks in their own names in their business licenses.
5. The scope of goods and services that a natural person applies for trademark registration is limited to the business scope approved by its business license or relevant registration documents, or to the self-operated agricultural and sideline products.
