Beijing Daoxiangcun trademark is real.
The "Daoxiangcun" trademark dispute ended with Beijing Daoxiangcun winning the case. However, Beijing Daoxiang Village held an emergency media communication meeting in Beijing and stated that Suzhou Daoxiang Village (hereinafter referred to as "Su Dao") still has a large number of infringements on the market. Beijing Daoxiang Village has launched four lawsuits against Su Dao. In addition to claiming nearly 40 million yuan, it also demands that Su Dao own all rights reserved. The word "Suzhou" must be added in front of the store plaque.
Because Suzhou Daoxiang Village widely uses the fan-shaped "Daoxiang Village", the borderless "Daoxiang Village" logo and the "Daoxiang Village" plaque that are highly similar to the Beijing Daoxiang Village trademark, consumers have made "wrong purchases" when purchasing Beijing Daoxiang Village products. It happens frequently, and it is difficult for consumers to safeguard their rights, and their right to know is seriously violated.
"If Su Dao uses its existing trademark, we have nothing to say," said Yin Bo, deputy general manager of Beijing Daoxiang Village. "Sudao has diluted the word 'Suzhou' on the outer packaging of the goods, and The use of the 'Daoxiangcun' trademark that is very similar to ours is obviously intentional infringement."
The reporter's inquiry found that the trademark owned by Suzhou Daoxiangcun is the Daoxiangcun trademark with a circular pattern, which is the same as the trademark owned by Beijing Daoxiangcun. The font and appearance are very different.
The reporter noticed yesterday in Wangfujing Street, Qianmen Street and other places that there are "Daoxiang Village" specialty stores here. The plaques use two styles of white characters on a red background and gold characters on a black background, which is exactly the same as the style of the Daoxiang Village plaque in Beijing. Very close.
Extended information:
Suzhou Daoxiang Village originated in 1773, 243 years ago. At that time, it was called "Suzhou Daoxiang Village Tea and Restaurant". When Emperor Qianlong went to the south of the Yangtze River and tasted Daoxiangcun pastries in Suzhou, he praised them as "exquisite food and rare delicacies" and inscribed a plaque on it, making it famous all over the world. The "Daoxiangcun" font and signboard written in calligraphy are still used on store signs, door headers and product packaging.
Beijing Daoxiang Village originated in 1895 AD when Guo Yusheng, a native of Jinling (now Nanjing), opened the "Daoxiang Village Nanhuo Store" in Guanyin Temple, Qianmen, Beijing, selling southern food. When Mr. Lu Xun lived in Beijing, he often went shopping, which was recorded more than ten times in "Lu Xun's Diary".
At that time, there was no such thing as trademark protection. Just like inns like to be called "Yelai" and restaurants like to be called "welcoming guests", before the founding of the People's Republic of China, many different businessmen across the country opened Daoxiangcun shops. After the founding of the People's Republic of China, some Daoxiangcun businesses closed down, while others struggled to survive.
Baoding Daoxiang Village is one of them. In 1982, Baoding Daoxiangcun Food Factory wanted to participate in the Ministry of Commerce's evaluation at that time and needed to register a trademark, so the factory leaders decided to apply for the "Daoxiangcun" round and picture trademark for biscuits. It is worth noting that this trademark is called the "Daoxiangcun" text and picture trademark by Su Dao, while Beidao insists on calling it the Daoxiangcun graphic trademark, but both parties admit that this is the earliest registered "Daoxiangcun" trademark.
In 1989, Baoding Daoxiangcun obtained the "Daoxiangcun" graphic trademark in the pastry category (3006). In 1995 and 1999, it was also recognized as "Hebei Province Famous Trademark".
In the 1970s, both Jiangsu and Beida were struggling to recover. In 1984, Beijing Daoxiang Village invited old technician Liu Zhenying back to resume operations. "At that time, there was a lack of raw materials, so we could only produce beef tongue cakes, trough cakes, Zhuangyuan cakes, and osmanthus vat stoves made from dim sum dregs," recalled Yin Bo, deputy general manager of Beijing Daoxiang Village.
At that time, Su Dao's life was not easy either. In 1976, Suzhou Daoxiang Village resumed operations on Guanqian Street, Suzhou, becoming the first time-honored brand to resume operations in Suzhou. In 1980, after changing its name several times, Suzhou Daoxiang Village restored the Daoxiang Village name. However, due to the large number of retirees and heavy burdens, development was slow.
Being preoccupied with themselves, neither Beijing Daoxiang Village nor Suzhou Daoxiang Village noticed that Baoding Daoxiang Village had registered the "Daoxiangcun" word and picture trademark, becoming the "Daoxiangcun" pastry protected by trademark law.
According to the enterprise name registration regulations, although the trademark belongs to Baoding, enterprises in other areas can still use "Daoxiangcun" as their corporate name and will not be affected.
It does not affect the continued operation, and there is no overlap in business for the time being, so for a long period of time, each family lives in peace and runs their own business.
