Article 2 The term “tobacco specialty products” as mentioned in these Regulations refers to cigarettes, cigars, shredded tobacco, recured tobacco leaves, tobacco leaves, cigarette papers, filter sticks, cigarette tows, and special tobacco machinery.

Cigarettes, cigars, cut tobacco, and recured tobacco leaves are collectively referred to as tobacco products. Article 3 All units and individuals engaged in the production, operation and transportation of tobacco monopoly products within the administrative area of ??this autonomous region must abide by these regulations. Article 4 The production, sale, import and export of tobacco monopoly products shall be subject to the tobacco monopoly license system in accordance with the law. The transportation of tobacco specialty products shall be subject to the transportation permit system in accordance with the law. The purchase of tobacco leaves shall be subject to a purchase license system in accordance with the law. Article 5 The tobacco monopoly administrative departments at or above the county level shall be in charge of tobacco monopoly work within their respective administrative regions.

Relevant departments such as public security, industry and commerce, taxation, customs, transportation, railways, and technical supervision shall, in accordance with their respective responsibilities, cooperate with the tobacco monopoly administrative department in the management of tobacco monopoly. Chapter 2: Production of Tobacco Monopoly Products Article 6: The autonomous region implements a system of unified planning, rational layout, and planned management for tobacco leaf planting. Financial support will be given to poor areas suitable for tobacco leaf cultivation and priority will be given to planting areas.

Tobacco companies should promptly provide tobacco growers with excellent varieties that have been approved by the national or autonomous region tobacco variety approval committee, and teach tobacco growers scientific planting, baking, grading and other technologies.

No unit or individual may withhold or misappropriate the funds and materials used by tobacco companies to support tobacco growers. Article 7 Tobacco companies or their entrusted units that purchase tobacco leaves shall sign a tobacco leaf planting and purchasing contract with tobacco leaf growers based on the tobacco leaf planting and purchasing plan issued by the planning department at or above the county level, agree on the tobacco leaf planting area, and determine the rights and obligations of both parties. Article 8 Tobacco product manufacturing enterprises must obtain a tobacco monopoly production enterprise license in accordance with the law, and after approval and registration by the administrative department for industry and commerce, produce in accordance with the annual total production plan issued by the administrative department of tobacco monopoly of the autonomous region. Article 9: Tobacco product manufacturers must indicate the tar content level and the Chinese words “Smoking is harmful to health” on the packages of cigarettes and cigars they produce.

Export cigarettes produced by tobacco product manufacturers must be marked with the Chinese words "Exclusively for Export" on small packages and strips. Article 10 Cigarettes, cigars and packaged cut tobacco must apply for registered trademarks. Without approval and registration, they may not be produced or sold.

It is prohibited to produce tobacco products with counterfeit registered trademarks. Article 11 To establish a manufacturing enterprise of cigarette paper, filter rods, cigarette tows, or special tobacco machinery, a tobacco monopoly manufacturing enterprise license must be obtained in accordance with the law. After approval and registration by the administrative department for industry and commerce, the enterprise must, in accordance with the regulations of the tobacco monopoly administrative department of the State Council, Organize production according to plans and order contracts signed with tobacco product manufacturers. Chapter 3 Purchase and Sale of Tobacco Monopoly Products Article 12 Tobacco companies and their entrusting units that purchase tobacco leaves must obtain a purchase license issued by the tobacco monopoly administrative department of the autonomous region and purchase within the prescribed area.

Tobacco companies and their entrusting units shall purchase all tobacco leaves produced by tobacco leaf growers in accordance with the planting area agreed in the tobacco leaf planting and purchase contract in accordance with the purchase standards and prices prescribed by the state, and shall not raise prices or reduce prices. Acquisition at a low price. Article 13 The technical supervision department, together with the tobacco monopoly administrative department, is responsible for the supervision and management of tobacco leaf procurement standards.

The county-level tobacco monopoly administrative department organizes representatives from township (town) people's governments and tobacco leaf producers to set up a tobacco leaf grade review group. If tobacco leaf growers have objections to the tobacco leaf grade determined by the tobacco leaf purchasing station (point), they may apply to the tobacco leaf grade review team for review. Article 14 Tobacco leaf growers shall sell self-produced tobacco leaves to the tobacco company or its entrusted unit specified in the tobacco leaf planting and purchase contract. Article 15: Tobacco leaves and re-cured tobacco leaves shall be allocated according to the plan, and national allocation price management regulations shall be implemented.

Tobacco leaves and recured tobacco leaves produced in poor areas can participate in inter-provincial transfers with the approval of the autonomous region's tobacco monopoly administrative department on the premise of ensuring the completion of the transfer plan issued by the autonomous region.

Article 16 Tobacco product manufacturing enterprises must sell the tobacco products they produce to tobacco companies holding a tobacco monopoly wholesale enterprise license. Article 17 The administrative department of tobacco monopoly of the autonomous region is responsible for formulating the cigarette purchase plan for the entire region. If a tobacco company purchases cigarettes and cigars from outside the area according to the plan, it must report to the administrative department of tobacco monopoly of the autonomous region for approval and obtain the issuance. shipping permit. Article 18: The wholesale business of tobacco products is managed uniformly by tobacco companies. Tobacco product wholesale units shall be issued a tobacco monopoly wholesale enterprise license by the tobacco monopoly administrative department of the autonomous region, and shall be approved and registered by the industrial and commercial administrative department.

Grassroots supply and marketing cooperatives or state-owned and collective commercial enterprises in towns and villages that do not have tobacco product wholesale units must obtain a tobacco monopoly entrusted wholesale license issued by the local tobacco monopoly administrative department at or above the county level, and obtain a tobacco monopoly entrusted wholesale license from the industrial and commercial administrative department. After approval and registration, you can engage in tobacco product wholesale business, but you must purchase goods from a tobacco company designated by the tobacco monopoly administrative department that issued the tobacco monopoly entrusted wholesale license.

Tobacco companies and their entrusting units engaged in the wholesale business of tobacco products shall not provide wholesale or retail supply of goods to units and individuals without tobacco monopoly retail licenses.
