Article 3 1 of the Trademark Law specifically stipulates that an application for registration of a trademark shall not damage the prior rights of others, nor shall it preempt the registration of a trademark that has been used by others and has certain influence by unfair means. This provision fully considers the protection of the interests of trademark registrants, and also fully emphasizes the social significance of the actual use of trademarks from one side.

According to China's Regulations on the Implementation of the Trademark Law, the use of registered trademarks can be marked with "registered trademarks" or registration marks on commodities, commodity packages, manuals or other accessories.
