Under what circumstances can the customs release the detained suspected infringing goods?
(1) The intellectual property right holder requests the customs to detain the goods suspected of infringement after discovering them, but the customs fails to receive the notice from the people's court requesting the customs to assist in executing the relevant ruling within 2 working days after detaining the goods; (2) After the customs fails to determine whether the goods concerned infringe the relevant intellectual property rights within 3 working days stipulated in the Regulations and notify the intellectual property rights holders, it fails to receive the notice from the people's court requesting the customs to assist in the execution of the relevant ruling within 5 working days from the date of detaining the goods; (3) The application of the consignee or consignor of the goods suspected of infringing the patent right to the customs for the release of the goods by counter-guarantee meets the conditions stipulated in the Regulations; (4) After investigation, the customs considers that the evidence provided by the consignee or consignor can prove that the detained goods have not infringed the relevant intellectual property rights. (5) Before the customs determines that the detained suspected infringing goods are infringing goods, the intellectual property right holder withdraws the application for detaining the suspected infringing goods.
