Why does trademark registration take so long?

A newly applied trademark generally takes about a year from application to issuance, of which application acceptance and formal review takes about one month, substantive review takes about four to five months, and the opposition period is three It takes about three months from the approval announcement to the issuance of the certificate.

As for why trademark application takes so long, there are many reasons. The main reason is that trademark review is done manually. Specifically:

First of all, examiners like to examine trademarks with plain text and just search them out directly. Among word trademarks, we prefer trademarks that can be rejected at a glance.

Because he can directly reject it without thinking, which usually includes:

1. Someone has applied for the same trademark before but failed, and this time it was rejected directly;

2. Trademarks with adverse effects, such as Bai Fumei and Gao Fushui, will be rejected without hesitation. However, for similar trademarks, it is necessary to compare the products in the similar trademarks to see whether they are similar across categories, whether each group is similar, etc., which will take more time. If the application is rejected, the corresponding rejection notice must be filled in.

Secondly, examiners really don’t like examining graphic trademarks. Please note that the Trademark Office system does not support automatic retrieval of graphics. You must read all similar graphics in the category. If you encounter similar trademarks across categories, you must also review all graphics in other categories. So it takes a long time to review a graphic trademark.

Once again, the Trademark Office will have some unexpected events that are incomprehensible. For example: when the new trademark law was implemented, the Trademark Office system was upgraded. It was originally planned to complete the upgrade in one month, but it took almost half a year. During this period, the trademark review work basically stopped, and the acceptance notice was not issued. Another example: the paper for the trademark certificate is gone, and a bidding process needs to be organized to buy the paper for the trademark certificate (this is not ordinary paper, it is specially treated printing paper with the national emblem printed on it, and the bidding unit must be a unit with safety qualifications).

Finally, the workload of the examiner is also relatively large. In fact, it may only take 10 minutes or half an hour to examine your trademark. But you have been waiting in line. On the one hand, the workload of review is huge. On the other hand, the front-end work of accepting, collecting, computer inputting, and dividing the documents is actually a huge workload. Due to the large number of trademarks, each All the sessions were spent in queue.
