Legal analysis: After a successful trademark application, there is no need to actively cancel the trademark if it is not used. After ten years of validity after registration, a trademark will be automatically canceled if it is not renewed; if it is not used for three years after registration, it will be revoked. Because the law stipulates that if a trademark has not been used for three consecutive years without justifiable reasons, anyone can apply to the Trademark Office to cancel the registered trademark.
Legal basis: Article 40 of the "Trademark Law of the People's Republic of China", if a registered trademark expires and needs to be continued to be used, the trademark registrant shall comply with the requirements within twelve months before expiration. It stipulates that the renewal procedures should be handled; if it cannot be handled during this period, a six-month extension period can be given. Each renewal of registration is valid for ten years, starting from the day after the expiration of the previous term of validity of the trademark. If renewal procedures are not completed upon expiration, the registered trademark will be cancelled. The Trademark Office shall announce the renewal of registered trademarks.
