How to charge for filing a case in court

It costs money to go to court to sue. The parties need to pay litigation fees to the people's court. It also costs money to find a lawyer. If you only consult a lawyer to discuss the lawsuit, you need to pay consulting fees. If you go to court to sue someone else or a company, you will need to pay a consulting fee. When safeguarding personal rights and interests, certain litigation fees are required, and the fees charged by the People's Court are often fair and appropriate. According to Articles 6, 8, and 10 of the "Measures for the Payment of Litigation Fees in People's Courts": After the People's Court accepts a civil lawsuit, the plaintiff who files the lawsuit generally pays the case acceptance fee in advance, and the plaintiff pays the litigation fees in advance after receiving the notice from the People's Court. Prepayment must be made within 7 days from the next day of notification. If the defendant files a counterclaim, the counterclaimant shall submit it in advance when submitting the counterclaim to the People's Court. If both parties file an appeal, the two parties to the appeal shall make advance submissions respectively. The main charges involved in a litigation activity include (non-property/property) case acceptance fees, other litigation costs (if any), lawyer fees (if required), etc. This is the litigation cost of the case. After the People's Court accepts a lawsuit filed by a party, it will charge a case acceptance fee based on the type and standard of the case. If the court actually needs other case-handling fees in the process of handling the case or handling other matters, it will also charge corresponding litigation fees. If a party has difficulty in paying the case acceptance fee in advance, he or she may apply to the People's Court for a postponement of payment within the advance payment period. If the party concerned fails to prepay the acceptance fee and appeal fee within the prepayment period, and does not submit an application for postponement of payment, the case will be automatically withdrawn. Who will bear the litigation costs will be decided based on the circumstances of the trial after the case is completed.
