What is the franchise?
Franchise refers to an individual or enterprise (i.e., the franchisor) who owns the operating system of unique products, equipment, trade patents or service marks, and gives other individuals or enterprises (i.e., the licensee) the right to conduct inter-bank business activities in a specified area and period in advance. Franchise generally includes three different forms: trademark franchise, product franchise and operating mode franchise. In China, there are two kinds of franchise rights, one is authorized by the government, allowing specific enterprises to use public resources or engage in specific businesses. The second is that one enterprise allows another enterprise to use the trademark or patent of this enterprise within a certain period and scope to carry out production and business activities under a unified business model. The term of the franchise is freely agreed by the franchisor and the franchisee. Article 6 of the Company Law When a company registers to establish a company, it shall apply to the company registration authority for registration of establishment according to law. Those that meet the conditions for establishment as stipulated in this Law shall be registered as limited liability companies or joint stock limited companies respectively by the company registration authority; Those who do not meet the conditions for establishment as stipulated in this Law shall not be registered as a limited liability company or a joint stock limited company. Where laws and administrative regulations stipulate that the establishment of a company must be approved, the approval procedures shall be handled according to law before the company is registered. The public may apply to the company registration authority to inquire about the registered items of the company, and the company registration authority shall provide inquiry services.
