The validity period of each renewal registration is ten years, counting from the day after the last expiration of the trademark. If the renewal formalities are not completed at the expiration of the period, the registered trademark shall be cancelled.

V. Application materials and handling procedures

(1) Preparation of application documents

1. The application documents to be submitted are:

(1) Application for trademark renewal registration

(2) Copy of the applicant's qualification certificate confirmed by seal or signature

(3) Power of Attorney submitted by the entrusted agent. Submit the ID card and photocopy of the agent directly in the trademark registration hall (the original is returned after comparison)

(4) Copy of the registration certificate

(5) If the application document is in a foreign language, a Chinese translation confirmed by the signature of the translation agency or agency should also be provided

2. Specific instructions

(1) Fill in one by one according to the requirements on the application, and it must be typed or printed. If the applicant is a natural person, the ID number should be filled in after the name.

(2) An application for renewal of registration shall be submitted for each trademark.

(3) If you come directly to the trademark registration hall, you should submit a copy of the ID card of the agent; Where a trademark agency is entrusted, a power of attorney for trademark agency shall be submitted.

(4) If the trademark applied for renewal is * * *, the application shall be made in the name of the representative.

(5) according to the provisions of article 34 of the trademark law, if the challenged trademark is approved for registration after ruling that the objection cannot be established, the time for the trademark registration applicant to obtain the exclusive right to use the trademark shall be counted from the date of expiration of three months from the announcement of preliminary examination. Therefore, if a trademark that is still in the process of objection, objection review or objection review has been renewed, it may apply for renewal within 12 months before the expiration of the validity period; Failing to file an application within this period, a six-month grace period may be granted. Our bureau will decide whether to approve the renewal according to the final result of objection, objection review or litigation. If the trademark is finally rejected for registration, our bureau will not approve the renewal application, and the application fee can be refunded.

(II) Submission of application documents

1. If it is handled directly, submit the application at the acceptance window of the trademark registration hall.

2. If a trademark agency is entrusted to handle the matter, the trademark agency shall serve the application to the Trademark Office.

(3) Payment of renewal fee

The application is charged by category, and the fee for applying for renewal of registration of a category is RMB 2,. If the application for renewal of registration is filed within the grace period, a delay fee of RMB in 5 yuan is also required.

if it is entrusted to a trademark agency, the trademark office will deduct the fees from the advance payment of the trademark agency.

VI. Precautions

1. After the renewal application is approved, the Trademark Office will issue the renewal certificate to the applicant. If it is handled directly, it will be sent to the applicant by post according to the address filled in the application; If it is represented, it will be sent to the agency organization.

2. If the application for renewal needs to be corrected, the Trademark Office will issue a notice of correction to the applicant (if it is handled directly, it will be sent to the applicant by mail according to the address filled in the application; The agent, sent to the agency), requiring the applicant to make corrections within a time limit. If the applicant fails to make corrections as required within the prescribed time limit, the Trademark Office has the right to disapprove the renewal application.

3. If the renewal application is rejected, the Trademark Office will issue a Notice of Rejection. If it is handled directly, it will be sent to the applicant by mail according to the address filled in the application form; If it is represented, it will be sent to the agency.

4. if the applicant entrusts a trademark agency to apply for renewal, the trademark office will send all the documents to the trademark agency.

5. The category of the application shall be filled in according to the international classification approved by the Trademark Registration Certificate.
