What are the functions of trademark registration objections?
(A), the positive role
Trademark objection has three important functions:
1, to protect the interests of the prior registrant of the trademark;
2. Protect the right of prior application of the preliminary trademark examiner;
3, to avoid the applicant for a registered trademark to obtain the exclusive right to use a trademark that should not be obtained.
(B), the negative impact
1. From the point of view of system design, although the objection procedure is not a procedure that every registered trademark must go through (according to statistics, the number of objected trademarks is about 2% ~ 3% of the initially approved announced trademarks), the objection period must go through from initial approval to approved registration. Even if there is no trademark objection, the trademark announced in the preliminary examination and approval will not be approved for registration before the expiration of the three-month objection period, thus extending the blank period of trademark protection.
2. The questioned trademark may only be flawed, and whether it can be registered in the end still needs to be reviewed by the relevant authorities. Judging from the actual situation of the trademark office's objection ruling, less than 50% of the trademarks ruled that the objection was established and not registered.
3. There may also be malicious objection, that is, using trademark objection procedures to prevent other people's trademarks from being registered in time for improper purposes.
