Title: Prohibited circumstances

Legal content: the national emblem and its pattern shall not be used for: (1) trademarks and advertisements; (2) the furnishings of daily life; (3) private celebrations and hanging activities; (four) other occasions when the General Office of the State Council stipulates that the national emblem and its pattern shall not be used.

Interpretation: This article is about prohibiting the use of the national emblem and its patterns. Article 8 of the Trademark Law of People's Republic of China (PRC) stipulates that a trademark shall not use the same or similar words or graphics as People's Republic of China (PRC)'s national name, national flag, national emblem, military flag and medal; Article 7 of the Advertising Law of People's Republic of China (PRC) stipulates that advertisements printed with China's national flag, national emblem and national anthem shall not be published, broadcast, set up or posted. In addition, the national emblem and its design shall not be used for furnishings and celebrations in private life. The General Office of the State Council stipulates that the national emblem and its design shall not be used on other occasions.
