Legal subjectivity:

(1) If the amount of illegal income (i.e. sales revenue, the same below) reaches the following standards for counterfeiting other people’s registered trademarks, the case should be filed: 1. Unregistered The trademark owner has permission to use the same trademark as his registered trademark on the same kind of goods, and the amount of illegal income is more than 20,000 yuan; 2. Selling goods that are knowingly counterfeit registered trademarks, and the amount of illegal income is more than 20,000 yuan; 3. , Forge or create without authorization the registered trademark logo of others or sell the registered trademark logo that has been forged or manufactured without authorization, and the amount of illegal income exceeds 10,000 yuan. Conspire with criminals who counterfeit registered trademarks of others and provide them with convenient conditions for manufacturing, selling, using, warehousing, transporting, mailing, concealing, etc. Criminals who counterfeit registered trademarks will be held criminally responsible. (2) Counterfeiting other people’s registered trademarks and any of the following circumstances shall be considered serious and the case shall be filed: 1. Those who have committed the acts listed in Item (1) of Article 2 of these Regulations and whose illegal business volume exceeds 100,000 yuan ; 2. Those who commit the acts listed in Article 2 (3) of these regulations, forge or manufacture without authorization registered trademarks of others or sell more than 20,000 pieces (sets) of forged or unauthorized registered trademarks. (3) Counterfeiting other people’s registered trademarks. Although the standards stipulated in Article 2 (1), (3) or Article 3 are not met, if one of the following circumstances occurs, the case will be considered serious and the case shall be filed: 1 . Being given two administrative penalties by the industrial and commercial administration department for counterfeiting other people’s registered trademarks and then counterfeiting other people’s registered trademarks; 2. Counterfeiting other people’s registered human drug trademarks; 3. Using bribery and other illegal means to promote counterfeit trademarked goods or counterfeit goods . Making trademarks registered by others without authorization; 4. Counterfeiting trademarks registered by others, causing adverse social impact and international impact.
