Legal analysis: There are two ways to apply for a registered certification trademark or collective trademark: (1) entrust a nationally recognized trademark agency to handle it. (2) The applicant goes directly to the trademark registration hall of the Trademark Office. Before applying for registration, the applicant had better make a trademark inquiry to confirm whether there is a prior trademark right. Where a trademark agency is entrusted to apply for registration, the trademark agency shall be responsible for the inquiry.
Legal basis: Article 2 of the Trademark Law of People's Republic of China (PRC). The Trademark Office of the State Council Administration for Industry and Commerce is in charge of the national trademark registration and management. The State Council Administration for Industry and Commerce has set up a Trademark Review and Adjudication Board to handle trademark disputes.
