Regulations of Hebei Province on Protecting the Legal Rights and Interests of Consumers
Chapter I General Provisions Article 1 In order to protect the legitimate rights and interests of consumers and strengthen social supervision over the production, operation and service of commodities, these Regulations are formulated in accordance with the provisions of the Constitution of People's Republic of China (PRC) and relevant laws and regulations and in light of the actual situation of our province. Article 2 The term "consumers" as mentioned in these Regulations refers to the units and individuals that accept goods or services for their daily needs. Article 3 Producers and operators mentioned in these Regulations refer to units and individuals engaged in the production and marketing of consumer goods or providing paid services to consumers.

All producers, operators, consumers, administrative organs and consumer associations within the province shall abide by the provisions of these regulations. Article 4 Consumer associations at all levels are social organizations that supervise the goods and services provided by producers and operators on behalf of consumers and protect the legitimate rights and interests of consumers. Consumers' associations have legal personality. Article 5 People's governments at all levels shall be responsible for the implementation of these Regulations within their respective administrative areas. Chapter II Rights and Obligations of Consumers Article 6 Consumers shall enjoy the following rights when purchasing commodities or receiving services:

(a) to know the real situation of goods and services from the producers and operators;

(2) Free choice of goods and services;

(three) to enjoy the protection of quality, measurement, hygiene, safety and legal price when purchasing goods or receiving services;

(four) the purchased goods do not meet the quality standards and require repair, replacement or return;

(five) when the legitimate rights and interests are damaged by buying goods or receiving services, demand compensation, make criticisms and suggestions, or make complaints and prosecutions;

(six) to report, expose or accuse the illegal acts of production operators. Article 7 Consumers have the following obligations:

(1) Abide by social ethics and respect the labor of producers and operators;

(2) Take care of commodities when selecting commodities;

(three) if the goods are not used or disassembled according to the instructions, causing damage to the goods or personal injury, they shall bear the responsibility. Chapter III Responsibilities of Producers and Operators Article 8 Producers and operators must be responsible to consumers, strictly implement relevant laws, regulations and policies, adhere to the principles of fairness, reasonableness, honesty and credit, and serve wholeheartedly, and shall not harm the legitimate rights and interests of consumers. Article 9 Producers and business operators must abide by the following provisions:

(a) the production and operation of goods should meet the quality standards prescribed by the state, and no shoddy, fake and shoddy;

(two) the production of goods should be accompanied by inspection certificate and instructions, and indicate the name and address of the factory. Commodities with a specified time limit must indicate the date of production and the period of validity;

(3) Commodities imported from abroad must be declared to the local commodity inspection authorities within the prescribed time limit and inspected according to the standards stipulated in the import contract. Sales are not allowed without inspection;

(four) the production and operation of goods must meet the safety and hygiene standards prescribed by the state;

(five) must strictly implement the price laws and policies, the price department has a unified pricing of goods or fees, are not allowed to raise prices without authorization, disguised price increases or overcharges;

(six) the production and operation of goods, are not allowed to counterfeit the registered trademark of others;

(7) Advertising must be true. Advertisers and advertising business units shall not resort to deceit, cheat or deceive consumers in any form;

(eight) the implementation of guaranteed repair, replacement and return of goods, must strictly fulfill the provisions or agreements;

(nine) are not allowed to produce and operate the state explicitly eliminated, prohibited and expired goods;

(ten) are not allowed to tying goods in any form;

(eleven) the operation of durable consumer goods, allowing on-site testing;

(twelve) the services provided to consumers should be safe and hygienic, and meet the technical and quality standards. Chapter IV Administration and Supervision Article 10 Departments in charge of industrial and commercial administration, price, standard measurement, sanitation, commodity inspection, industry and judicial organs at all levels shall, according to their respective functions and duties, strengthen the administration and supervision of producers and operators; Acts that violate the relevant laws, regulations and rules and harm the legitimate rights and interests of consumers shall be investigated and dealt with in a timely manner according to law. Eleventh provinces, cities (districts) and counties to establish consumer associations, townships, towns, urban streets and enterprises and institutions can voluntarily establish organizations to protect the legitimate rights and interests of consumers according to the requirements of consumers. Article 12 A consumer association shall perform the following duties:

(1) Accepting consumer complaints, and investigating and mediating the complaints. If mediation fails, it may apply to the Consumer Dispute Arbitration Commission for arbitration;

(two) in conjunction with the relevant departments to inspect and measure the quality, price, safety, hygiene and measurement of goods and services;

(three) to criticize and expose the producers and operators who harm the legitimate rights and interests of consumers, and to announce them to the public through public opinion, or to suggest that the relevant administrative departments shall be punished according to the regulations;

(four) cooperate with the relevant departments to investigate and deal with fake and shoddy goods;

(five) to participate in the selection or revocation of the title of brand-name products;

(six) to participate in the drafting of laws, regulations and normative documents on protecting the legitimate rights and interests of consumers;

(seven) to supervise the implementation of the relevant provisions on the standardization of goods and services;

(eight) to solicit and collect the opinions of consumers, feedback the quality information of goods and services to producers and operators, and report directly to the people's government or make suggestions to relevant departments;

(9) Guide consumers to spend scientifically and rationally;

(ten) to ask the parties about the behavior that harms the legitimate rights and interests of consumers, and the interviewee must give a written reply within fifteen days;

(eleven) to support or represent consumers and bring a lawsuit to the people's court for acts that seriously damage the legitimate rights and interests of consumers.
