Three , Search
Since trademark application is a complicated and long process, in order to avoid futility and waste of money during the application process, registration search is an indispensable link. A search can usually yield two results. One is to know whether the applied trademark is duplicated or similar to others; the other is to know whether our trademark complies with the government's standards for trademark laws. The law does not stipulate that you must go through a registration search, but we strongly recommend that you do a complete search before applying for registration.
4. Submit application
Complete the application form and sign or stamp it. In order for the application to proceed smoothly, all information must be prepared before the application is submitted.
The most important point is to determine the trademark registration category. When choosing a category, in addition to choosing the category for your own business, you can also choose some related categories to prevent others from using other categories to infringe on your trademark. Intellectual property rights, of course, some people register all categories. Generally speaking, according to international standards, trademarks are divided into 45 categories.
After the Intellectual Property Department accepts the application, it will conduct a preliminary review of the application. If it meets the standards stipulated in the Trademark Ordinance and is not duplicated or similar to previous applications, the application will enter the announcement stage. During the announcement period, if there is no objection from others, the chances of getting the certificate are very high.
5. Use of "Priority"
Among many trademark applications, if there are similarities or similarities, the Trademark Office will usually decide who should own the application in order. The first applicant will enjoy "priority". After the applicant obtains the "Notification of Acceptance" from the Trademark Registration Office, he does not have to worry about others counterfeiting the application, because our application has been protected by "priority". But when we use it, we can only put the word "TM" on the trademark; after the applicant obtains the "Registration Certificate" and issuance, the applicant can use the word "a" on the trademark. From the date of application, the applicant can file a lawsuit with the relevant authorities if any infringement is discovered.
6. Singapore Trademark Registration Procedure
1 The applicant (or his agent) submits an application form to the Trademark Registration Office and pays the specified fee.
2. After receiving the application form, the Trademark Registry will review the application to ensure that the application complies with the relevant provisions of the Trademark Ordinance. If after review it is determined that the application does not comply with the provisions of the Trademark Regulations, the Trademark Registry will issue a report stating the reasons why the trademark cannot be registered.
3. If the trademark registration application is deemed to have no problems after review, an advertisement for the trademark registration will be published in the government gazette.
4. Anyone can object to the registration application of the relevant trademark within two months after the advertisement is published. If no objection to registration is received, the Trademark Registry will officially register the trademark.
5. Finally, the Trademark Registry will issue a registration certificate to the applicant.
7. Timetable for trademark application
The trademark acceptance notice will be handed over to the customer in 3 months, and the certificate issuance time will be about 12-18 months (generally). The trademark certificate is valid for 10 years. , then renew it after 10 years and it will become a permanent registration.
