Road motor vehicle manufacturers and products are divided into six categories: passenger cars, trucks, buses, special vehicles, motorcycles and trailers. Bus road motor vehicle manufacturers and products are divided into complete vehicles and modified vehicles.
The term "road motor vehicles" as mentioned in these Measures refers to wheeled vehicles that are driven or towed by power devices and run on roads for people to ride or transport goods and carry out special engineering operations, excluding automobile trains, trolleybuses, trams, wheeled special mechanical vehicles, tractors and tractor transport units. Article 3 The Ministry of Industry and Information Technology is responsible for the access, supervision and management of road motor vehicle manufacturers and products throughout the country.
The competent departments of industry and information technology of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall, in accordance with the provisions of these Measures, cooperate with the Ministry of Industry and Information Technology to implement the work related to the access, supervision and management of road motor vehicle manufacturing enterprises and products within their respective administrative areas. Article 4 Road motor vehicle production enterprises shall organize production according to the contents of road motor vehicle production enterprises and product access, and shall be responsible for the quality and production consistency of road motor vehicle products. Chapter II Application and Acceptance Article 5 To apply for access to road motor vehicle manufacturing enterprises, the following conditions shall be met:
(1) Having the qualification of a legal person;
(two) to complete the formalities and construction of investment projects in accordance with the relevant provisions of the state on investment management;
(3) Having a place, funds and personnel suitable for engaging in production activities;
(four) with product design and development capabilities, production capacity, production consistency assurance capabilities and after-sales service assurance capabilities. Suitable for production activities;
(5) Other conditions stipulated by laws, administrative regulations and rules. Article 6 To apply for access to road motor vehicle products, the following conditions shall be met:
(a) to enter the road motor vehicle production enterprises;
(two) the road motor vehicle products produced can meet the technical standards and safety technical conditions of safety, environmental protection, energy saving and anti-theft formulated and issued by the Ministry of Industry and Information Technology;
(3) Other conditions stipulated by laws, administrative regulations and rules. Article 7 The following materials shall be submitted to the Ministry of Industry and Information Technology to apply for the access of road motor vehicle production enterprises:
(1) Application for the access of road motor vehicle manufacturing enterprises (the model text is produced and published by the Ministry of Industry and Information Technology);
(two) according to the provisions of the state on investment management for investment projects;
(3) A copy of the articles of association and business license stamped with the official seal of the enterprise;
(four) a letter of commitment signed by the legal representative of the enterprise to carry out the production of road motor vehicle products according to law. Article 8 To apply for access to road motor vehicle products, the following materials shall be submitted to the Ministry of Industry and Information Technology:
(a) road motor vehicle products and categories, characteristics, technical functions and other information;
(two) the main technical parameters of road motor vehicle products, including the parameters representing the basic characteristics of road motor vehicle products, and the parameters and pictures related to the safety, environmental protection, energy saving and anti-theft performance of road motor vehicle products. ;
(3) Inspection data of road motor vehicle products, including statistical tables of inspection items, descriptions of sample vehicles, inspection reports issued by inspection and testing institutions, etc. (The inspection report of road motor vehicle parts listed in the catalogue of compulsory product certification can be replaced by compulsory product certification certificate);
(4) Explanatory materials for the legal use of the trademark of road motor vehicle products (provided only when applying for the first time for the access of road motor vehicle products containing the trademark), and materials such as environmental protection information of road motor vehicle products shall be disclosed according to law. Ninth road motor vehicle production enterprises have the right to independently choose the inspection and testing institutions that have obtained relevant qualifications according to law to conduct road motor vehicle product inspection; To carry out vehicle inspection, inspection and testing institutions that have obtained the qualification of the National Product Quality Supervision and Inspection Center shall be selected.
The road motor vehicle products submitted for inspection shall be manufactured by the applicant, and the relevant technical parameters shall be consistent with the road motor vehicle products applied for access. Article 10 The Ministry of Industry and Information Technology shall, after receiving the application for road motor vehicle manufacturing enterprises and product access, conduct a review according to law. If the application materials are incomplete or do not conform to the prescribed form, the applicant shall be informed of all the contents that need to be supplemented at once on the spot or within five working days; If the application materials are complete and conform to the prescribed form, it shall be accepted. Chapter III Review and Decision Article 11 The Ministry of Industry and Information Technology entrusts technical service agencies to organize experts to conduct technical review of road motor vehicle manufacturing enterprises and product access applications. Twelfth technical service institutions shall objectively and fairly conduct technical evaluation, and truthfully report the evaluation results to the Ministry of Industry and Information Technology.
