Legal analysis: Regarding the starting date of the validity period of a registered trademark, Article 37 of the Trademark Law stipulates that it shall be counted from the date of approval of registration. According to Article 3 of the Trademark Law, "any person may raise an objection to a trademark that has been preliminarily approved within three months from the date of announcement. If there is no objection at the expiration of the announcement period, the registration shall be approved, the trademark registration certificate shall be issued, and the announcement shall be made. The so-called approval date is the first day of the fourth month from the date of announcement of the preliminarily approved trademark.
However, for a trademark that has been approved for registration after the objection is determined to be untenable, the date of approval for registration is often after the expiration of three months of the preliminary examination announcement. Therefore, Article 34, paragraph 3, of the Trademark Law clearly stipulates: "If the registration is approved after the objection is determined to be untenable, the time for the trademark registration applicant to obtain the exclusive right to use the trademark shall be counted from the expiration of three months of the preliminary examination announcement." It is worth noting that the 1-year period is calculated from the first day of the fourth month from the date of the announcement of the preliminary examination, and the expiration date is the corresponding day of the last month. If there is no corresponding day in the last month, the expiration date is based on the last day of the month.
