Problems, causes, current situation and countermeasures regarding intellectual property rights in my country

1. my country’s intellectual property system was established relatively late, with a history of only more than 20 years. After more than 20 years of development, our country has formed intellectual property laws such as patent law, trademark law, and copyright law that are basically consistent with the requirements of the Trips Agreement, and has formulated other laws and regulations related to intellectual property rights. However, we should be clearly aware that the overall situation of my country's intellectual property work still has problems that are not compatible with the development requirements of the country's economy, science and technology, and society, as well as with the development requirements of the new international situation we are facing. Mainly manifested in:

①Weak awareness of intellectual property rights. In 2008, among the 426,000 industrial enterprises above designated size in the country, approximately 2.1% of the total number of enterprises had applied for invention patents, and approximately 0.6% of the total number of enterprises had obtained invention patent rights. At present, the export volume of my country's own-brand goods accounts for less than 10% of the total export volume, and less than 20% of domestic export enterprises (excluding foreign-funded enterprises) have domestic registered trademarks. ② There are partial deficiencies in my country’s basic intellectual property legal system. Some laws are not very operable and need to be improved and modified. ③ There are many management departments related to intellectual property. Under the fragmented management system, there is a lack of communication channels and coordination mechanisms between management departments. Policy coordination is poor, and management overside and absence coexist. ④ Intellectual property protection reaches the level of middle- and high-income countries. However, the level of intellectual property enforcement is not high, and there is still a certain degree of local protection. ⑤ The intellectual property management system of most enterprises and institutions is not sound, they lack the ability to flexibly use the intellectual property system and international rules, and the level of enterprises using intellectual property strategies is low.

Countermeasures of national intellectual property strategy:

(1). Efforts should be made to improve the intellectual property awareness of the whole society. (2). Efforts should be made to create an environmental atmosphere conducive to the protection of intellectual property rights. (3). Effectively strengthen countermeasure research on the macro-strategy of intellectual property rights at the national level. (4). Strengthen the construction of an intellectual property legal system that is in line with international practices. (5). Actively promote enterprises and institutions to establish and improve intellectual property management systems. (6). Establish and improve the intellectual property management work system and intellectual property coordination mechanism. (7). Vigorously promote the implementation of patented technologies.
