What is the review process of the Trademark Office?

The process of trademark reexamination is: after the trademark application is rejected, if the applicant is not satisfied with the rejection decision, he can apply to the Trademark Review and Adjudication Board for reexamination within fifteen days of receiving the rejection notice. The Trademark Board will make an evaluation result within nine months after receiving the reexamination application and notify the applicant in writing of the evaluation result. If the applicant is not responsible for the decision, he may file a lawsuit with the People's Court within thirty days from the date of receipt of the notice.

Legal Basis

Article 34 of the "Trademark Law of the People's Republic of China" For a trademark that rejects the application and refuses to be announced, the Trademark Office shall notify the trademark registration application in writing people. If the trademark registration applicant is dissatisfied, he may apply to the Trademark Review and Adjudication Board for review within fifteen days from the date of receipt of the notice. The Trademark Review and Adjudication Board shall make a decision within nine months from the date of receipt of the application and notify the applicant in writing.
