The procedures for customs filing of intellectual property rights include application, review, and certification.
1. Apply. When the rights holder applies for customs protection registration to the General Administration of Customs, he should obtain a registration application form from the customs in advance. The right holder or his agent should fill in the application form as required, attach relevant documents, and submit or mail it to the General Administration of Customs.
The rights holder shall submit a filing application in accordance with the principle of one application for one right, that is, each application can only apply for one intellectual property right on the certificate of rights. The application form should be filled in Chinese, and the application documents submitted for inspection must be authentic and valid. The following content should be filled in the filing application as required:
(1) Rights. The Chinese and English names, country and region, business license number, legal address, legal representative, contact person's name, contact number, and fax on the registration document; the agent's name, address, license number, legal representative, and contact person name, contact number, fax, etc.
(2) The name of the registered trademark, registration number, validity period, approved goods, patent name, authorized number, brief content, validity period; copyright-related content.
(3) Names and commodity codes of goods related to intellectual property rights.
(4) The name, location, usage method and validity period of the license of the person authorized or licensed to use the intellectual property.
(5) The main characteristics of the goods related to intellectual property rights, trademark patterns and photos of product appearance and packaging.
(6) The manufacturer of the known infringing goods, the name and address of the imported and exported goods, the name of the suspected infringing goods, the main entry and exit customs, etc.
(7) Description of trade secrets.
(8) Other circumstances that the General Administration of Customs deems should be explained.
