Measures for the Administration of Trademark Printing (1996)
article 1 these measures are formulated in accordance with the relevant provisions of the trademark law of the people's Republic of China and the detailed rules for the implementation of the trademark law of the people's Republic of China (hereinafter referred to as the trademark law and the detailed rules for the implementation of the trademark law) in order to strengthen the administration of trademark printing, protect the exclusive right to use registered trademarks and maintain social and economic order. Article 2 Enterprises and individual industrial and commercial households registered in accordance with the law to engage in printing, printing and dyeing, plate making, lettering, word weaving, sun etching, iron printing, molding, stamping, hot stamping, decals and other businesses that need to undertake trademark printing business shall apply for the Certificate of Trademark Printing Unit. Article 3 The Certificate of Trademark Printing Unit shall be uniformly printed by the State Administration Bureau and issued by the local (city) level administration for industry and commerce; To undertake the trademark printing business of tobacco products and medicines for human use, it shall be issued by the provincial administration for industry and commerce. Article 4 To apply for the Certificate of Trademark Printing Unit, the following conditions shall be met:

(1) Having the technology, equipment and storage facilities suitable for its trademark printing business;

(2) having sound rules and regulations for the management of trademark printing business;

(3) There are three or more persons who have obtained the Qualification Certificate for the Management Personnel of Trademark Printing Business. Article 5 The qualification of a trademark printing business manager shall be produced after examination by the provincial administration for industry and commerce, and its certificate shall be uniformly printed by the State Administration for Industry and commerce and issued by the provincial administration for industry and commerce. Article 6 To apply for the Certificate of Trademark Printing Unit, an Application Form for Trademark Printing Unit shall be filled in as required, and submitted to the local county-level administration for industry and commerce, together with relevant documents that can prove the contents mentioned in Article 4 of these Measures. Article 7 The county-level administration for industry and commerce shall, within 3 days from the date of receiving a complete application, sign an opinion and report it to the local (city) level administration for industry and commerce.

The provincial administration for industry and commerce shall make a decision within 3 days from the date of receiving the application. Article 9 The Certificate of Trademark Printing Unit shall be verified once every two years, and the trademark printing unit shall apply to the issuing authority for verification within two months before the expiration of every two years through the local county-level administration for industry and commerce. If it fails to apply for verification within the time limit, the local county-level administration for industry and commerce shall order it to make corrections within a time limit; Those who refuse to make corrections shall be reported to the issuing authority and their Certificate of Trademark Printing Unit shall be revoked.

if the trademark printing unit no longer meets the requirements as stipulated in article 4 of these measures due to personnel changes, it shall stop the trademark printing business and submit the certificate of trademark printing unit to the local county-level administration for industry and commerce, which will hand it over to the issuing authority. Article 1 Where the name, domicile, legal representative and other major registered items of a trademark printing entity change, it shall, within 3 days after the relevant formalities are handled by the registration authority, apply to the issuing authority for a new certificate through the local county-level administration for industry and commerce. Article 11 Where a trademark printing client entrusts a trademark printing unit to print a trademark, it shall produce a copy of the business license or a legal business certificate or identity certificate. Article 12 Where a trademark printing client entrusts the printing of a registered trademark, it shall produce the Trademark Registration Certificate or a copy of the Trademark Registration Certificate signed by the county-level administration for industry and commerce where the registrant is located, and provide another copy.

if the licensee needs to print a trademark by signing a trademark license contract to use another person's registered trademark, it shall also produce the text of the trademark license contract and provide a copy; Where a trademark registrant authorizes the licensee to print a trademark alone, it shall present the power of attorney and provide a copy in addition to the copy of the Trademark Registration Certificate signed and sealed by the county-level administration for industry and commerce where the registrant is located. Article 13 When a trademark printing unit undertakes the trademark printing business, the trademark printing business manager shall strictly check the following contents of the relevant certification documents and trademark patterns provided by the trademark printing client:

(1) The trademark sample to be printed shall be the same as the trademark pattern on the Trademark Registration Certificate, and shall be marked with the words "registered trademark" or marked with [note] or [r];

(2) The printing of unregistered trademarks shall not violate the provisions of Article 8 of the Trademark Law, and the words "registered trademark" shall not be marked, or [note] or [r] marks shall be used;

(3) If the licensee prints the trademark, it has a clear power of attorney or the text of the trademark license contract produced by it contains the contents that the licensor allows it to print the trademark; The sample trademark shall indicate the name and address of the licensee's enterprise. Article 14 If the trademark printing client fails to provide the supporting documents specified in Articles 11 and 12 of these Measures, or if the trademark required to be printed does not meet the requirements of Article 13 of these Measures, the trademark printing unit shall not undertake printing.

for those who meet the requirements, the trademark printing business management personnel shall fill in the Trademark Business Registration Form as required, indicating the main contents of the certification documents provided by the trademark printing client, and the trademark pattern in the Trademark Printing Business Registration Form shall be stamped with the riding seal by the trademark printing business personnel.

where a trademark printing unit prints unregistered trademarks, it shall sign a contract with the trademark printing client, specifying the legal responsibilities that both parties shall bear if the printed trademarks infringe upon the exclusive right to use registered trademarks of others.

a trademark printing unit shall indicate the serial number of the Certificate of Trademark Printing Unit on the trademark logo it prints.
