Unqualified food refers to fake and shoddy food whose relevant indicators fail to meet the food safety standards stipulated by laws and regulations. Food producers and operators are responsible for the food safety of their production and operation. Food producers and business operators shall engage in production and business activities in accordance with laws, regulations and food safety standards, ensure food safety, be honest and self-disciplined, be responsible to the society and the public, accept social supervision and assume social responsibilities.

Article 39 The state practices a licensing system for the production of food additives. To engage in the production of food additives, it is necessary to have a place, production equipment or facilities, professional and technical personnel and management system suitable for the varieties of food additives produced, and obtain a food additive production license in accordance with the procedures specified in the second paragraph of Article 35 of this Law. The production of food additives shall comply with food safety laws, regulations and national standards.

Article 52 Producers of food, food additives and food-related products shall inspect their food, food additives and food-related products in accordance with food safety standards, and only after passing the inspection can they leave the factory or sell them.
