Is it true that only collectives can apply for collective trademarks? Is it okay for individuals?
A collective trademark refers to a sign registered in the name of a group, association or other organization and used by members of the organization in business activities to show the membership of users in the organization. Collective trademarks, like ordinary trademarks, must be approved and registered by the Trademark Office if they want to enjoy the exclusive right to use trademarks and be protected by law. 1. Where it is generally necessary to apply for collective trademark registration, it shall be declared in the application for trademark registration, and (1) the qualification certificate of the subject shall be submitted, detailing the names and addresses of the members of the collective organization; (2) Use management rules. The management rules for the use of collective trademarks shall include: (1) the purpose of using collective trademarks; (two) the quality of the goods using the collective trademark; (3) Procedures for using the collective trademark; (four) the rights and obligations to use the collective trademark; (five) the responsibility that a member should bear in violation of its use management rules; (6) the inspection and supervision system of the registrant on the goods using the collective trademark.
