Duration of protection of exclusive right to use a trademark

The protection period of a trademark right is ten years, counting from the date when the Trademark Office approves the registration

However, the law allows the trademark owner to renew it, and the trademark registrant can apply to the Trademark Office for renewal twelve months before the expiration, after which the trademark registrant can continue to enjoy the exclusive right to use the trademark

According to Article 39 of the Trademark Law of the People's Republic of China, the validity period of a registered trademark is ten years, and the registration is approved. If the registration fails to be completed within this period, a six-month grace period can be granted.

The validity period of each renewal registration is ten years, counting from the day after the expiration of the previous period of validity of the trademark.

If the renewal procedures are not completed at the expiration, the registered trademark will be cancelled.

The Trademark Office shall announce the renewed registered trademark.

Legal basis

The validity period of the registered trademark in Article 39 of the Trademark Law of the People's Republic of China is as follows. If the registration fails to be completed within this period, a grace period of six months may be granted.
