What if the trademark is about to expire?
Legal analysis: the validity period of a registered trademark is 10 year. Where it is necessary to continue to use a registered trademark after its expiration, it shall apply for renewal within one year before its expiration. If the application cannot be submitted during this period, there will be a grace period of 6 months. If no application is filed within the grace period, the Trademark Office will revoke it after the expiration. Six to seven months after the Trademark Office accepts the application for renewal of a registered trademark, the Trademark Office will make an announcement and issue a formal renewal certificate if it meets the conditions for renewal after examination and approval. The validity period of the renewed trademark is calculated from the day after the last expiration of the trademark, and the validity period of each renewal registration is ten years.

Three steps of application:

(1) Preparation of application documents

The application documents to be submitted are:

(1) trademark renewal registration application

(2) the applicant's identity certificate (copy)

(3) The entrusted agent submits the power of attorney.

(4) Copy of registration certificate

(5) If the application documents are in a foreign language, a Chinese translation signed and confirmed by the translation agency shall also be provided.

(2) submit an application.

1. If the applicant goes directly to the trademark registration hall, after the application is ready, submit it in the acceptance window of the trademark registration hall, and the window staff will confirm whether the application is qualified.

2. Where a trademark agency is entrusted, the trademark agency shall serve the application to the Trademark Office.

(3) Payment of renewal fee.

Legal basis: Article 40 of the Trademark Law of People's Republic of China (PRC). Where a registered trademark needs to be used continuously after the expiration of its term of validity, the trademark registrant shall go through the renewal procedures in accordance with the provisions within 12 months before the expiration. If it has not been handled during this period, it can be extended for six months. The validity period of each renewal registration is ten years, counting from the day after the last expiration of the trademark. If the renewal formalities are not completed at the expiration of the period, the registered trademark shall be cancelled.

The Trademark Office shall announce the renewed registered trademark.
